Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL. —The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-6 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for halogen atom, an alkyl group, an alkenyl group, an acyl group, an acyloxy group, an alkoxycarbonyl group, a hydroxy group; an alkoxy group, an aryl group, a heteroaryl group, a cycloalkyl group, and a cyano group, does not reasonably provide enablement for “substituent”. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and/use the invention commensurate in scope with these claims.
The nature of the instant invention has claims which embrace substituted indeno[1,2-b]quinoxaline compounds.
The compound (A) of Formula (I) is a solvate substituted by R1, R2, R3, R4, R5 and R6 are defined as a substituent but fails to set forth that which the applicants regard as there invention. The specification does not define that which is intended in the “substituent”. The following is a list of substituents, i.e. a mercapto group, a thioalkoxy group having 2 to 6 carbon atoms, an amino group, an alkylamino group, a carboxy group, an alkylcarbonyloxy group, a carbamoyloxy group, halogenated alkyl group, a hydroxyalkyl group, etc., which includes substituents that are neither supported nor contemplated. This is just a few common substituents embraced by “substituent”.
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION. —The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The following reasons apply:
Claims 1, 6 and claims dependent thereon are vague and indefinite in that it is not known what is meant by “R3 to R6”, which is a range which does not particularly point out and distinctly claim the subject matter which applicants regard as the invention, i.e., it fails to indicate that which is embraced by the range. The definitions of each individual variable must be clearly set forth herein.
Claim 2 is vague and indefinite in that it is not known what is meant by “R3 to R5”, which is a range which does not particularly point out and distinctly claim the subject matter which applicants regard as the invention, i.e., it fails to indicate that which is embraced by the range. Claim 6 is vague and indefinite in that it is not known what is meant by “X to Z”, which is a range which does not particularly point out and distinctly claim the subject matter which applicants regard as the invention, i.e., it fails to indicate that which is embraced by the range. The definitions of each individual variable must be clearly set forth herein.
