Claim Rejections - 35 USC § 103 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-20-aia AIA The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. 07-21-aia AIA Claim (s) 1-29 is/are rejected under 35 U.S.C. 103 as being unpatentable over Zhang US 20250168702 in view of Park US 20250350523 1. An apparatus for wireless communication, comprising: a processing system that includes processor circuitry and memory circuitry that stores [[ code ]], the processing system configured to cause the apparatus to: output first information signaling that indicates a primary frequency band and that indicates a secondary frequency band (Zheng: [0074-0075, 0099] enhanced multi-link single radio secondary channel (EMLSR-SC) operation, and/or Dynamic Subband Operation (DSO)…. transmit an initial control frame for example, indicate a resource assignment on the primary subchannel to one or more STAs (e.g., potentially including STAs that could only handle the operating bandwidth of the primary subchannel, in some instances) and indicate a resource assignment on the secondary subchannel to one or more other STAs (e.g., potentially including STAs that can handle the full operating bandwidth (i.e., outside of primary bandwidth ) of the AP wireless device and that support EMLSR-SC operation (and/or DSO), in some instances)) , wherein the secondary frequency band is outside of the primary frequency band (Zhang: [0074-0075] full operating bandwidth of the AP wireless device) ; output second information signaling that indicates the primary frequency band (Zhang: [0075, 0099-0101] transmit an initial control frame for example, indicate a resource assignment on the primary subchannel to one or more STAs (e.g., potentially including STAs that could only handle the operating bandwidth of the primary subchannel, in some instances)) ; output a first physical layer protocol data unit (PPDU) associated with a first PPDU format via a time resource and the secondary frequency band, wherein a first preamble of the first PPDU indicates that the first PPDU is intended for a second wireless node (Zheng: [0072, 0084-0089, 0098, 0099-0101] transmit a trigger frame (556) having one Common info field, possibly one Special User info field (e.g., information-indicating different variants of User info fields), and multiple User info fields, and each user info field may be an HE variant, EHT variant or UHR variant User info field corresponding to solicitation of an HE, EHT or UHR uplink PPDU) ; and output a second PPDU associated with a second PPDU format via the time resource and the primary frequency band, wherein a second preamble of the second PPDU indicates that the second PPDU is intended for a third wireless node (Zheng: [0084-0089, 0098, 0099-0101] transmit a trigger frame (556) having one Common info field, possibly one Special User info field (e.g., information-indicating different variants of User info fields), and multiple User info fields, and each user info field may be an HE variant, EHT variant or UHR variant User info field corresponding to solicitation of an HE, EHT or UHR uplink PPDU) . Zhang merely discloses the term “stores code ” Park further teaches stores code (Park: [0040] memories connected to a processors and may store a code) Thus, it would have been obvious to one skill in the art before the effective filing date of the claim invention to include the above recited limitation into Zhang’s invention in order to make a first PPDU format to be transmitted in the first frequency band, and a second PPDU format to be transmitted in the second frequency band without overlap with each other [0199], as taught by Park. 2. Regarding claims 15-29, the independent claim and each dependent claim are related to the same limitation set for hereinabove in claims 1-14, where the difference used is a “non-transitory computer-readable storage medium” and the wordings of the claims were interchanged within the claim itself or some of the claims were presented as a combination of two or more previously presented limitations. This change does not affect the limitation of the above treated claims. Adding these phrases to the claims and interchanging the wording did not introduce new limitations to these claims. Therefore, these claims were rejected for similar reasons as stated above.
