Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This Office Action is in response to the application filed June 17, 2024.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Cha et al. (US 2017/0288093 A1).
In regard to claim 1, Cha et al. teach a light emitting diode (LED) pixel for a display, comprising: a first LED stack 10 having a first well layer 10b (page 3, paragraph [0039]); a second LED stack 20 disposed on the first LED stack 10 and having a second well layer 20b (page 3, paragraph [0039]); a third LED stack 30 disposed on the second LED stack 20 and having a third well layer 30b (page 3, paragraph [0039]); a first electrode 12a disposed on the first LED stack 10 and in ohmic contact with the first LED stack 10; a second electrode 22a disposed on the second LED stack 20 and in ohmic contact with a majority of a surface of the second LED stack 20; and a third electrode 32a in ohmic contact with a surface of the third LED stack 20, wherein the first well layer 10a includes at least one base material different from that of the second well layer 20a (Figure 38, pages 2-10, paragraphs [0037]-[0146]).
