Office Action

§101
CTNF 18/748,491 CTNF 91492 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Double Patenting 08-30 AIA A rejection based on double patenting of the “same invention” type finds its support in the language of 35 U.S.C. 101 which states that “whoever invents or discovers any new and useful process... may obtain a patent therefor...” (Emphasis added). Thus, the term “same invention,” in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co. , 151 U.S. 186 (1894); In re Vogel , 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Ockert , 245 F.2d 467, 114 USPQ 330 (CCPA 1957). A statutory type (35 U.S.C. 101) double patenting rejection can be overcome by canceling or amending the claims that are directed to the same invention so they are no longer coextensive in scope. The filing of a terminal disclaimer cannot overcome a double patenting rejection based upon 35 U.S.C. 101. 08-31 AIA Claim 1 is/are rejected under 35 U.S.C. 101 as claiming the same invention as that of claim 1 of prior U.S. Patent No. 12,055,784 . This is a statutory double patenting rejection. Current Application: 18/748,491 Patent No. 12,055,784 1 . A camera body to be removably attached to an accessory including an accessory-side mount and accessory-side terminals, the camera body comprising: a body-side mount being ring-shaped centering around an optical axis and being configured to be in contact with the accessory-side mount; a body-side terminal group including a plurality of body-side terminals configured to be in contact with the accessory-side terminals upon attachment to the accessory; a first body-side projecting portion projecting from the body-side mount in an inner periphery direction of the body-side mount and extending in a circumferential direction around the optical axis; a second body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis; a third body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis; and a fourth body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis, wherein the first body-side projecting portion and the third body-side projecting portion are disposed on a fourth body-side line intersecting at the optical axis with a first body-side line at 45 degrees, the first body-side line passing through the optical axis and a central portion of the body-side terminal group, the second body-side projecting portion and the fourth body-side projecting portion are disposed on a third body-side line orthogonal to the fourth body-side line at the optical axis, and at least one of a first center angle formed by a line connecting one end of the first body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the first body-side projecting portion in the circumferential direction and the optical axis; a second center angle formed by a line connecting one end of the second body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the second body-side projecting portion in the circumferential direction and the optical axis; a third center angle formed by a line connecting one end of the third body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the third body-side projecting portion in the circumferential direction and the optical axis, and a fourth center angle formed by a line connecting one end of the fourth body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the fourth body-side projecting portion in the circumferential direction and the optical axis is different from the other center angles. 1 . Allowable Subject Matter Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under Double Patenting, set forth in this Office action. Regarding claim 1 , closest prior art Inoue JP-2000047308A teaches a camera body (see Fig. 2: camera body 30) to be removably attached to an accessory including an accessory-side mount and accessory-side terminals (as shown in Fig. 2: front side of camera body 30 has 4 bayonet claws for mounting interchangeable lens 40), the camera body comprising: a body-side mount being ring-shaped centering around an optical axis and being configured to be in contact with the accessory-side mount (Fig. 1 and para 0019: “The camera 30 is provided with a connecting portion 31 which is electrically connected to the interchangeable lens 40” and para 0034: “The interchangeable lens 40 is mounted on the camera 30 by a mounting method. When the interchangeable lens 40 is applied to the mount portion of the camera 30 and rotated rightward, the mount claws on the camera side and the interchangeable lens side are engaged”); a body-side terminal group including a plurality of body-side terminals configured to be in contact with the accessory-side terminals upon attachment to the accessory (Figs. 1- 2 and para 0019: “A plurality of terminals A1, C1 to C5, A2, and A3 are sequentially arranged in the connecting portion 31” and para [0026]: “When the interchangeable lens 40 is attached to the camera 30, the interchangeable lens 40 is connected to each terminal provided on the connecting portion 31 of the camera 30 and each terminal provided on the connecting portion 41 of the interchangeable lens 40. That is, A1 and B1, A2 and B2, C1 to C5 and D1 to D5 are connected”); a first body-side projecting portion projecting from the body-side mount in an inner periphery direction of the body-side mount and extending in a circumferential direction around the optical axis (see below annotated Fig. 2 and para 0034: “When the interchangeable lens 40 is applied to the mount portion of the camera 30 and rotated rightward, the mount claws on the camera side and the interchangeable lens side are engaged”); a second body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis (see below annotated Fig. 2 and para 0034: “When the interchangeable lens 40 is applied to the mount portion of the camera 30 and rotated rightward, the mount claws on the camera side and the interchangeable lens side are engaged”); a third body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis (see below annotated Fig. 2 and para 0034: “When the interchangeable lens 40 is applied to the mount portion of the camera 30 and rotated rightward, the mount claws on the camera side and the interchangeable lens side are engaged”); and a fourth body-side projecting portion projecting from the body-side mount in the inner periphery direction of the body-side mount and extending in the circumferential direction around the optical axis (see below annotated Fig. 2 and para 0034: “When the interchangeable lens 40 is applied to the mount portion of the camera 30 and rotated rightward, the mount claws on the camera side and the interchangeable lens side are engaged”), [AltContent: textbox (Plurality of terminals)][AltContent: arrow][AltContent: ][AltContent: arrow][AltContent: textbox (Fourth body-side projecting portion)][AltContent: textbox (Third body-side projecting portion)][AltContent: arrow][AltContent: textbox (Second body-side projecting portion)][AltContent: textbox (First body-side projecting portion)][AltContent: arrow][AltContent: arrow] PNG media_image1.png 690 736 media_image1.png Greyscale However, Inoue fails to teach : wherein the first body-side projecting portion and the third body-side projecting portion are disposed on a fourth body-side line intersecting at the optical axis with a first body-side line at 45 degrees, the first body-side line passing through the optical axis and a central portion of the body-side terminal group, the second body-side projecting portion and the fourth body-side projecting portion are disposed on a third body-side line orthogonal to the fourth body-side line at the optical axis, and at least one of a first center angle formed by a line connecting one end of the first body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the first body-side projecting portion in the circumferential direction and the optical axis; a second center angle formed by a line connecting one end of the second body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the second body-side projecting portion in the circumferential direction and the optical axis; a third center angle formed by a line connecting one end of the third body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the third body-side projecting portion in the circumferential direction and the optical axis, and a fourth center angle formed by a line connecting one end of the fourth body-side projecting portion in the circumferential direction and the optical axis and a line connecting the other end of the fourth body-side projecting portion in the circumferential direction and the optical axis is different from the other center angles. Remarks: see also applicant’s page 11 remarks filed on 08/10/2023, for application No.17/404,575. Conclusion 07-96 AIA The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
