The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
Claims 2, 4-6, 8, 10, 11, 13, 15, 16 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding Claims 2,8,13 it is unclear and perhaps redundant to say the switch “is configured to detect the specific movement of the switch.” “The specific movement” is not positively recited and lacks antecedent basis. Correction is required.
Regarding Claims 4,10,15 the “output modes” are not positively recited and lack antecedent basis. Correction is required.
Regarding Claims 5,11,16 “the output mode” is not positively recited and lacks antecedent basis. Correction is required.
Regarding Claim 6, “capable of wireless communication with a receiver connected to an effect device” does not clearly recited a structural and functional relationship to the structures recited in the parent claim. Correction is required.
Allowable Subject Matter
Claims 1, 3, 7, 9, 12, 14 are allowed.
Claims 2, 4-6, 8, 10, 11, 13, 15, 16 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
