Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 2, 13, 14, and 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Shen CN 112333661.
Regarding claim 1, 13, 20, Shen teaches an information transmission method, comprising:
sending, by a first terminal, 2nd stage Sidelink Control Information (SCI), wherein
the 2nd stage SCI comprises a first indicator field indicating that the 2nd stage SCI is used to transmit request information or used to transmit coordination information (That is, in the alternative embodiment, the coordination information can be carried on 2nd-stage SCI, RRC signaling or MAC CE for transmission, claim 12).
Regarding claims 2, 14, transmitting, by the first terminal, the request information or the coordination information for one or more times, wherein transmitting, by the first terminal, the request information or the coordination information for one or more times comprises:
transmitting, by the first terminal, the request information or the coordination information for one or more times based on a preset number of retransmissions,
wherein:
the request information is used to request a second terminal to feed back the coordination information, and
the coordination information is used to provide sidelink resource selection information for the second terminal (claim 12, That is, in the alternative embodiment, the coordination information can be carried on 2nd-stage SCI, RRC signaling or MAC CE for transmission).
Claim(s) 1, 2, 13, 14, and 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Hwang WO 2023043283.
Regarding claim 1, 13, 20, Hwang teaches an information transmission method, comprising:
sending, by a first terminal, 2nd stage Sidelink Control Information (SCI), wherein
the 2nd stage SCI comprises a first indicator field indicating that the 2nd stage SCI is used to transmit request information or used to transmit coordination information (In this case, the first SCI (eg, first second stage SCI) and the second SCI (eg, second second stage SCI) are indicators indicating the request or the coordination information between terminals (eg, Providing/Requesting indicator field ) may be included).
Regarding claims 2, 14, transmitting, by the first terminal, the request information or the coordination information for one or more times, wherein transmitting, by the first terminal, the request information or the coordination information for one or more times comprises:
transmitting, by the first terminal, the request information or the coordination information for one or more times based on a preset number of retransmissions,
wherein:
the request information is used to request a second terminal to feed back the coordination information, and
the coordination information is used to provide sidelink resource selection information for the second terminal (In this case, the first SCI (eg, first second stage SCI) and the second SCI (eg, second second stage SCI) are indicators indicating the request or the coordination information between terminals (eg, Providing/Requesting indicator field ) may be included).
Allowable Subject Matter
Claims 3-8, 10, 11, 15-19, 21, and 22 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Response to Arguments
Applicant’s arguments with respect to claim(s) have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
