DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This action is in response to the amendment filed on 07/14/2026.
Claims 1, 3, 5-15, 17-20 have been amended.
Claims 1-20 are rejected.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation "the downtime duration" in line 11 of the claim. There is insufficient antecedent basis for this limitation in the claim.
Claims 2-10 depend either directly or indirectly on claim 1 and are rejected under 35 U.S.C. 112(b) as a result.
Claim 11 recites the limitation "the downtime duration" in line 9 of the claim. There is insufficient antecedent basis for this limitation in the claim.
Claims 12-19 depend either directly or indirectly on claim 1 and are rejected under 35 U.S.C. 112(b) as a result.
Claim 20 recites the limitation "the downtime duration" in line 11 of the claim. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 1-20 are allowable if amended to overcome the rejections under 35 U.S.C. 112(b) set forth in this OFFICE ACTION.
The following is a statement of reasons for the indication of allowable subject matter:
As per claim 1, the examiner found no prior arts that teach or fairly suggest, either alone or in combination, each and every limitations of the claim when the claim is taken into the consideration as a whole. The closest prior art cited by the examiner is Kwon et al. (KR 20220110963 A) [hereafter Kwon]. Kwon discloses method of determining a device status being disconnected from a cloud server using a heartbeat signal; temporarily storing backup data received from the device when the device is determined to be disconnected from the cloud server; and transmitting the backup data stored to the cloud server to recover the data that was lost by the cloud server when the device was disconnected. Kwon however, fails to teach “one or more devices are one or more sensors associated with an industrial unit”, “transmit the metadata of the downtime data associated with the downtime duration of the one or more devices” and “ re-process the persisted uptime data and the persisted downtime data”
Claim 11 and claim 20 are a method claim and a computer-readable storage medium claim corresponding to the system claim 1 and are allowable for the same reasons.
Claims 2-10 and 12-19 depend either directly or indirectly on claim 1 or 11 and are allowable for the same reasons.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
EP 3901869 A1 and JP 2021174056 A disclose a method for tracking a work performance information of a system to a server. A control unit of a system records value detected by a sensor in an off-line state in a storage unit and transmits the detection value recorded in the storage unit to the server when the off-line state changes to an on-line state.
