Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C.
102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the
basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 14, 27 and 40 are rejected under 35 U.S.C. 102 (a) (1) as being anticipated
by Borgonovo, NPL: Epistemic Uncertainty in the Ranking and Categorization of Probabilistic Safety Assessment Model Elements: Issues and Findings.”, 2008.
Referring to claim 1, Borgonovo teaches a computing system for reducing epistemic uncertainty in complex systems employing an artificial intelligence-driven simulation and experimental design decision platform (abstract, effects of epistemic uncertainty), comprising: one or more hardware processors configured for:
generating and running simulation scenarios based on user-defined or artificial intelligence agent defined objectives and constraints, and iteratively adjusting simulation parameters or perturbations using statistical or machine learning techniques or artificial intelligence techniques or stochastic search methodologies to optimize state space exploration and ultimate experimental or analysis scenario outcomes or coverage (page 984, para. 7; and sec. 4: ‘The effects of epistemic uncertainty on changes evaluation);
providing a scalable and interactive simulation environment(s) that enables real-time monitoring, analysis, and adaptation of a simulated system based on evolving real-world conditions and user, expert, or group feedback (page 985, para. 3, global sensitivity analysis; see also: sec. 5.2. categorization);
generating machine and human-interpretable insights and plans, explanations, and recommendations based on the simulation results, employing explainable artificial intelligence techniques to facilitate understanding and decision-making or downstream actions (abstract, page 997, para. 1);
integrating with external data sources, machine learning models, and domain-specific knowledge bases to enhance the accuracy, relevance, and utility of simulation outcomes (page 999, sec. 6: an application: the evaluation of changes with epistemic uncertainty); and
quantifying and reducing the epistemic uncertainty associated with the simulated system by employing probabilistic reasoning, targeted exploration, and continuous learning from both simulated or synthetic and real-world data (abstract and sec. 6 and 7; integrates quantitative and qualitative information).
Referring to claim 14, This claim is similar in scope to claim 1, and is therefore rejected under similar rationale.
Referring to claim 27, This claim is similar in scope to claim 1, and is therefore rejected under similar rationale.
Referring to claim 40, This claim is similar in scope to claim 1, and is therefore rejected under similar rationale.
Allowable Subject Matter
Claims 2-13, 15-26, 28-39 and 41-52 are objected to as being dependent upon a rejected
base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
