Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1 and 2 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Hu (CN Publication 219801140). Regarding claim 1, Hu discloses a cell-to-pack (CTP) battery mounting structure comprising: a mounting box 11, a plurality of single cells 2 side by side in the box body, and a clamping block 12, wherein the mounting box has a base plate and two crossbeam plates 112 (side walls) and is open upward, wherein the clamping block comprises a first wedge block 122 that has a fixing plate 121 that is fixed to the crossbeam plate and a second wedge block 123 that is interposed between the first wedge block and the stack of cells, and wherein the first and second wedge blocks have inclined surfaces that match one another so that the first wedge block has a thickness that gradually increases upward and the second wedge block has a thickness that gradually decreases upward (Paragraphs 0030, 0031, 0034 and Fig. 1) As to claim 2, Hu teaches that the structure includes a plurality of insulating adhesive layers 3 that fixes the second wedge block to the cell stack (Paragraph 0036). Hu teaches every limitation of claims 1 and 2 of the present invention and thus anticipates the claims.
