Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-8 are rejected under 35 U.S.C. § 102(a)(1) as being anticipated by Choi et al (2004). Applicant claims pharmaceutical compositions comprising a compound of Formula (I) for use in reducing hyperpigmentation thereof. Choi et al (2014) also disclose pharmaceutical compositions comprising an identical stilbene compound for treating hyperpigmentation, which anticipates the instantly claimed inventions, wherein R1, R2, R3, R4 and R8 are hydrogen or hydroxyl [ PNG media_image2.png 222 556 media_image2.png Greyscale , STN International, CAPLUS database, Accession Number 2004 : 970528, a copy is provided with this Office action]. Claims 1-8 are also rejected under 35 U.S.C. § 102(a)(2) as being anticipated by Zhang et al (US 10,188,590). Applicant claims pharmaceutical compositions comprising a compound of Formula (I) for use in reducing hyperpigmentation thereof. Zhang et al (US ‘590) also disclose similar skin-protection pharmaceutical compositions comprising compound and the method of uses thereof, which anticipate the instantly claimed inventions, wherein R1, R2, R3, R4 and R8 are hydrogen or hydroxyl [ PNG media_image3.png 326 262 media_image3.png Greyscale , Claim 1, column 49-50, US ‘590].
