CTNF 18/766,179 CTNF 74903 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Drawings 06-36 AIA The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the curved shape of the support portion, as recited in claim 9 must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 9-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 9 and 15, it is unclear how the first sidewall of the support portion has an inclination angle when the sidewall has a curved shape. Clarification is needed. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15-aia AIA Claim(s) 1-3 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Clague 3,582,115 . In regard to claim 1, Clague discloses (see fig. 1) a gas injection device comprising: a support portion 4 including a support having a first sidewall 9 extending at a first slope; a sealing cap 15 comprising an elastic material and having a second sidewall 16 extending at a second slope; and a pipe connection portion 10 including a conduit shape having a through-hole extending in a first direction, the pipe connection portion having one end portion connected to one end portion of the sealing cap, wherein the first sidewall and the second sidewall are arranged to face each other, and a first inclination angle formed by the first direction and the first sidewall is greater than a second inclination angle formed by the first direction and the second sidewall (see fig. 1 or fig. 3). In regard to claim 2, wherein the support portion includes a nut 4, and the pipe connection portion includes a nipple 10 having one side capable of being fastened to the nut 4. In regard to claim 3, wherein, based on the support portion 4 and the pipe connection portion 10 being fastened to each other and the pipe connection portion moving in the first direction with respect to the support portion, the sealing cap 15 is compressed between the support portion 4 and the pipe connection portion 10 . 07-15-aia AIA Claim(s) 9-11 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Cattoni 1,506,564 . In regard to claim 9, Cattoni discloses (fig. 3) a gas injection device comprising: a support portion 8 including a first sidewall 8b having a curved shape extending with a first curvature; a sealing cap 9 comprising an elastic material and having a second sidewall of a curved shape extending with a second slope; and a pipe connection portion 10 having a conduit shape and including a through-hole extending in a first direction, the pipe connection portion having one end portion connected to one end portion of the sealing cap 9, wherein the first sidewall and the second sidewall are arranged to face each other, the first sidewall extending to have a first inclination angle with the first direction, the second sidewall having a curved surface extending to have a certain curvature in the first direction, and an inclined surface extending in a straight line between a first point at which the curved surface starts (first end of 9) and a second point at which the curved surface ends (opposite end of 9) has a second-first inclination angle with the first direction, the first inclination angle being greater than the second-first inclination angle. In regard to claim 10, wherein the support portion includes a nut 8, and the pipe connection portion 10 includes a nipple having one side capable of being fastened to the nut. In regard to claim 11, wherein, based on the support portion and the pipe connection portion being fastened to each other and the pipe connection portion 10 moving in the first direction with respect to the support portion 8, the sealing cap 9 is compressed with respect to the support portion . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 4-8 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. 07-43-02 AIA Claim s 12-15 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Conclusion 07-96 AIA The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Ziegler, Parker, Haury, Hudson, Franck, Chiou, Crawford, Ross and Sotolongo disclose similar couplings that are common and well known in the art .
