Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1:
The claim recites “(by mass)”, however, it is not clear that the limitation in the parenthesis is part of the claim
The claim recites that “weight ratio of NaOH+0.713KOH to the clinker is 0-0.03:1”. However, it is not clear how the ratio could be zero when the cement contains NaOH, KOH, or combination thereof.
The term “long” in claim 1is a relative term which renders the claim indefinite. The term “long” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention.
The term “stable” in claim 1 is a relative term which renders the claim indefinite. The term “stable” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention.
The claim recites “predominated by a glass phase”, however, it is not clear that the glass phase content is the highest or else in the clinker.
Prior art considered
CN110451827 discloses preparation method of alkali excitation cement, which is mainly composed of glass phase by firing, chemical composition is mainly SiO2, Al2O3, CaO, Na2O and K2O of clinker to prepare alkali excitant consumption low alkali excitation cement. CN110451827 discloses mixing industrial alkali, limestone and potassium sodium aluminosilicate raw material, grinding to fineness of 100 meshes sieve, then fully calcining in the oxidizing atmosphere at 1250 to 1350 ° C, quenching to obtain dry clinker, grinding the clinker to 200 meshes sieve residue less than or equal to 10 % of fineness after mixing sodium water glass to obtain cement. The potassium-aluminum silicate raw material contains SiO2, Al2O3; Na2O and/or K2O; the mass ratio of SiO2 + Al2O3 + Na2O + K2O + CaO + MgO is not less than 95.0 % in the residue after oxidizing and calcining at 1100 degrees centigrade; and in the total mass of SiO2 + Al2O3 + Na2O + K2O + CaO + MgO, the content of each component is CaO: 0 to 5.0 %, MgO: 0 to 2.0 %, SiO2: 50.0 to 75.0 %, Al2O3: 15.0 to 35.0 %; Na2O + K2O: 5.0 to 11.0 %. See Summery of the invention. However, CN110451827 does not disclose nor render obvious all the cumulative limitations of claim 1 for example the content of the constitutes.
