Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-2 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Cao, CN202410203090.
Regarding claims 1-2, Cao discloses a multi-layer carpet comprising an upper layer carpet and a lower layer carpet wherein the upper layer carpet includes a carpet surface layer and a carpet back layer [2 fabrics] and wherein the lower carpet layer includes a carpet surface layer and a skid-proof layer [abstract]. The abstract also discloses that the upper carpet layer and the lower carpet layer are detachably connected through the carpet back of the upper carpet body and the carpet surface of the lower carpet layer. Examiner is corresponding the Applicant’s top screen layer (1) as Cao’s upper carpet layer surface layer. Examiner is corresponding Cao’s surface layer of the lower carpet layer as Applicant’s supporting layer and Cao’s skid-proof layer as Applicant’s cushion layer. Applicant’s claims are not specific to the top screen layer; supporting layer and cushion layer.
Claims 3-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Applicant claims a plug-in type detachable as recited in claim 1. The closest prior art, Cao, CN202410203090, teaches a multi-layer carpet comprising an upper layer carpet and a lower layer carpet wherein the upper layer carpet includes a carpet surface layer and a carpet back layer [2 fabrics] and wherein the lower carpet layer includes a carpet surface layer and a skid-proof layer [abstract]. The abstract also discloses that the upper carpet layer and the lower carpet layer are detachably connected through the carpet back of the upper carpet body and the carpet surface of the lower carpet layer. Cao fails to teach or suggest the limitations as recited in claims 3-18.
