Information Disclosure Statement
Applicant should note that the large number of references in the attached IDS have been considered by the examiner in the same manner as other documents in Office search files are considered by the examiner while conducting a search of the prior art in a proper field of search. See MPEP 609.05(b). Applicant is requested to point out any specific references in the IDS which they believe may be of particular relevance to the instant claimed invention in response to this office action.
Claim Objections
Claims 12 and 15 are objected to because of the following informalities: line 3 of claim 12 states “the first sheet-like component and configured to have a first initial tensile…” (emphasis added), however it is though the word “and” was added in error, since the statement does not make sense; it is suggested the word “and” be deleted to correct this issue. Additionally, lines 1-2 of claim 15 states “about 10% to 50% the load of the tendon…”, however this statement is found to be grammatically incorrect; it is suggested the word “of” be added between the words “50%” and “the”, on line 1, to correct this issue. Appropriate correction is required.
Applicant is advised that should claim 2 be found allowable, claim 9 will be objected to under 37 CFR 1.75 as being a substantial duplicate thereof. When two claims in an application are duplicates or else are so close in content that they both cover the same thing, despite a slight difference in wording, it is proper after allowing one claim to object to the other as being a substantial duplicate of the allowed claim. See MPEP § 608.01(m).
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claims 1-4, 7-9, 12 and 13 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 18-21 of U.S. Patent No. 10,265,156; and claims 1, 4, 7, 8 and 20 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 15 and 16 of U.S. Patent No. 10,888,415. Although the claims at issue are not identical, they are not patentably distinct from each other because all sets of claims disclose a tendon repair implant comprising a first sheet-like component having a first porosity and configured to have a first initial tensile modulus, in a range of about 5 megapascals (MPa) to 50 MPa; and a second sheet-like component having a second porosity and configured to have a second initial tensile modulus, in a range of about 50 megapascals (MPa) to 150 MPa, the second porosity less than the first porosity and the second initial tensile modulus greater than the first initial tensile modulus; and wherein either: the first sheet-like component is defined by a longitudinal dimension, a lateral dimension, and a thickness dimension, wherein the longitudinal dimension is greater than the lateral dimension and the thickness dimension, and wherein the first sheet-like component further comprises one or more longitudinal pathways extending along the longitudinal dimension of the first sheet-like component, and/or the plurality of pores have sizes between about 20 microns and 400 microns and at least some of the plurality of pores extend parallel to a longitudinal axis of the first sheet-like component, and/or the first sheet-like component is configured to degrade in tensile strength from a first initial tensile strength at a first rate and the second sheet-like component is configured to degrade in tensile strength from a second initial tensile strength at a second rate different from the first rate.
