Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 3 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by WO 2021241147 A1.
In regard to claim 1, WO 2021241147 A1 discloses a shield unit, comprising:
a coaxial electric wire 10 including an internal electric wire 11, an electric wire shield 13 covering an outer periphery of the internal electric wire 11, and an outer skin 14 covering an outer periphery of the electric wire shield 13;
a sleeve 15 assembled to a terminal part where the electric wire shield 13 is exposed from the outer skin 14 of the coaxial electric wire 10, and having an outer periphery covered with a folded-back part of the electric wire shield 13 which is folded back; and
a shield member 20 having a shield crimping part 25 which is crimped to an outer periphery of the folded-back part of the electric wire shield 13, wherein
the shield member 20 is provided with an outer skin crimping part 26 which is disposed on a coaxial electric wire side from the shield crimping part 25, and crimped to an outer periphery of the outer skin 14 of the coaxial electric wire 10,
the sleeve 15 is provided with an abutment part (distal end surface of sleeve 15, see annotated drawing below) which abuts on the outer skin crimping part 26 when the coaxial electric wire 10 and the shield member 20 move in a direction separated from each other,
the abutment part is not disposed on an inner diameter side of the shield crimping part 25, and
an end surface of the outer skin crimping part 26 on the shield crimping part side is disposed to face an end surface of the abutment part (distal end surface of sleeve 15, see annotated drawing below) on the coaxial electric wire side in a length direction of the coaxial electric wire 10.
In regard to claim 3, WO 2021241147 A1 discloses the abutment part is exposed from the folded-back part of the electric wire shield 13 (see annotated drawing below).
