The instant application claims priority under 35 USC 119(a)-(d) from EP 23188330.7, filed July 28, 2023.
Information Disclosure Statement
The information disclosure statements (IDS) submitted on July 26, 2024 and April 22, 2026 were in compliance with the provisions of 37 CFR 1.97 and 1.98. Accordingly, the IDS documents have been considered and signed copies of the 1449 forms are attached.
Status of the Claims
The listing of claims filed July 26, 2024 has been examined. Claims 1–22 are pending.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. § 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 10 and 19 are rejected under 35 U.S.C. § 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention.
Claim 10 recites the limitation “compound (2a) is obtained by…” There is insufficient antecedent basis for this limitation in the claim, since claim 1 from which it depends does not reference any compound (2a). Claim 19 recites the limitation "from compound (3) or from compound (2b)." There is insufficient antecedent basis for this limitation in the claim. Claim 1, from which the claim depends, does not mention any compound (3) or (2b). Appropriate correction of each instance is required.
Conclusion
Claims 1-9, 11-18 and 20-22 are allowed.
