Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 10 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. In claim 10, lines 8 and 9 disclose the phrase “radical initiator” which is not present in the specification.
Claim 11 is dependent from claim 10 and is allowable for the reasons given above.

Claims 10-11 are allowed.
The following is an examiner’s statement of reasons for allowance: The prior art of record fails to teach or fairly suggest to one of ordinary skill in the art at the time of the invention, in conjunction with all the other claimed limitation, a method of making a functionalized cyan pigment particle having all the claimed features of applicant's instant invention, specifically including: providing monomethacrylate- terminated poly(dimethylsiloxane); dispersing the copper phthalocyanine pigment core, monomethacrylate-terminated poly(dimethylsiloxane), and methyl methacrylate monomers in a nonpolar solvent to make a dispersion; providing a radical initiator to the dispersion; heating and stirring the dispersion including the radical initiator; and separating a copper phthalocyanine pigment core coated with methacrylate- terminated poly(dimethylsiloxane) from the dispersion, as set forth in the claims.
テルファー, スティ(JP2017526980), hereinafter ‘980, discloses an electrophoretic medium has a fluid, first light-scattering white particles, and subtractive three primary colors which are magenta, cyan, and yellow, a second Particles, third particles, and fourth particles, and at least two of these colored particles are non-light scattering. The cyan particle is a copper phthalocyanine material that is coated by dispersion polymerization and incorporates methyl methacrylate. ‘980 is silent to providing monomethacrylate- terminated poly(dimethylsiloxane) and heating and stirring the dispersion including the radical initiator.
川守田 正雄 (JP4617528), hereinafter ‘528, discloses a method for producing a copper phthalocyanine pigment composition, wherein the copper phthalocyanine crude is obtained by reacting phthalic anhydride or a derivative thereof with urea or a derivative thereof and a copper compound, or reacting a phthalodinitrile with a copper compound. It is obtained by washing the unpurified copper phthalocyanine immediately after synthesis. ‘528 is also silent to providing monomethacrylate- terminated poly(dimethylsiloxane) and heating and stirring the dispersion including the radical initiator.
Claim 11 is dependent from claim 1 and is allowable for the reasons given above.
