DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-3 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Yu et al, hereinafter Yu (U.S. 2016/0254572 A1).
In regards to claim 1, Yu discloses: a method for manufacturing a battery (Yu, fig. 2, title, & abstract), comprising:
a first injection step of injecting a first electrolytic solution that contains lithium bis(fluorosulfonyl)imide into an electrode body having a positive electrode, a negative electrode, and a separator interposed between the positive electrode and the negative electrode; a first charging step of performing first charging after the first injection step; a first aging step of performing aging treatment after the first charging step (Yu, fig. 2, disclosed in ¶ [0090]- ¶ [0112], ¶ [0119], ¶ [0140]- ¶ [0141], & ¶ [0176]; please note, the office construes the aging step to be commensurate to the result of the first/second charging/activation steps that is responsible for providing the activation of the improved output & lifetime characteristics {i.e., aging treatments});
a second injection step of injecting a second electrolytic solution that does not contain lithium bis(fluorosulfonyl)imide into the electrode body after the first aging step; a second charging step of performing second charging after the second injection step; and a second aging step of performing aging treatment after the second charging step (Yu, fig. 2, disclosed in ¶ [0090]- ¶ [0101], ¶ [0112]- ¶ [0115], ¶ [0119], ¶ [0140]- ¶ [0141], & ¶ [0176] please note, the office construes the aging step to be commensurate to the result of the first/second charging/activation steps that is responsible for providing the activation of the improved output & lifetime characteristics {i.e., aging treatments}).
In regards to claim 2, Yu discloses: the method for manufacturing a battery according to claim 1, wherein the second electrolytic solution contains lithium hexafluorophosphate (Yu, fig. 2 & ¶ [0176] {i.e., utilizing

In regards to claim 3, Yu discloses: the method for manufacturing a battery according to claim 1, wherein a working potential of a positive-electrode active material included in the positive electrode is 4 V (vs. Li/Li+) or less (Yu, fig. 2 disclosed in ¶ [0033]- ¶ [0034], ¶ [0102], & ¶ [0115]; please note, the voltage is charged with respect to the electrode material).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Please refer to PTO-892 form.
