Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Hu (20190230261) hereafter Hu.
Regarding claim 1, Hu discloses in fig. 2-2 a driving mechanism for moving an optical element (2-1200), comprising: a fixed part (21120); a movable part (2-1110), movably connected to the fixed part for holding the optical element (fig. 2-2, par. [0422]-[0424]); and a driving assembly (2-1150 and 2-1140 as the claimed driving assembly), configured for moving the optical element relative to the fixed part (par. [0422]-[0424]).
Claims 2-23 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: the prior art does not disclose the claimed combination of limitations to warrant a rejection under 35 USC 102 or 103.
Regarding claim 2 (and its dependents), the prior art does not disclose the claimed driving mechanism specifically including as the distinguishing features in combination with the other limitations the claimed “wherein the fixed part includes a shield, and the movable part includes a resilient circuit board, wherein at least a part of the circuit board is located between the substrate and the shield.”
Regarding claim 23 (and its dependents), the prior art does not disclose the claimed driving mechanism specifically including as the distinguishing features in combination with the other limitations the claimed “wherein the fixed part includes a shield, the movable part includes a resilient circuit board, and the driving mechanism further comprises a first frame and a second frame disposed on the circuit board, wherein the driving assembly is disposed on the shield, the first frame, and the second frame, and the second frame is located between the first frame and the shield.”
