Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 1-10 are rejected under 35 U.S.C. 103 as being unpatentable over Chandley (US Pub. No. 2006/0101293) in view of Swedberg (US Pub. No. 2007/0057952).
Regarding claim 1, Chandley shows a method for adaptive multi-window technology, comprising:
detecting a multi-window scenario corresponding to a plurality of windows on an electronic device ([0030]-[0032]);
determining priorities of the plurality of windows ([0034]-[0036]);
monitoring a [performance index] of the electronic device (battery life: [0035]);
checking whether resource re-allocation is needed according to the performance index[] (according to policy, heuristics: [0035]-[0036]);
determining targets of the plurality of windows if resource re-allocation is needed (e.g., target RGB values, refresh rates, etc.: [0038]-[0043]); and
changing profiles of the targets according to a resource re-allocation algorithm (see [0038]-[0043]).
Chandley does not explicitly show monitoring a plurality of performance indices.
Swedberg shows monitoring a plurality of performance indices (see [0003]-[0005], [0023], [0040]-[0042]).
It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the system of Chandley with the teachings of Swedberg in order to observe performance across multiple dimensions, thereby catching more categories of performance challenges than would be possible with measuring only a single dimension.
Regarding claim 2, the combination shows the limitations of claim 1 as applied above and further shows wherein detecting the priorities of the plurality of windows is detecting the priorities of the plurality of windows according to window focus, finger touching, usage time and/or window size (see Chandley, [0035]-[0037]).
Regarding claim 3, the combination shows the limitations of claim 1 as applied above and further shows wherein monitoring the plurality of performance indexes is monitoring frames per second (FPS), hardware loading and/or thermal status (see Swedberg, [0023], [0029]).
Regarding claim 4, the combination shows the limitations of claim 1 as applied above and further shows the plurality of windows providing profiles to a platform of the electronic device (see Chandley, [0005], [0038]-[0043]).
Regarding claim 5, the combination shows the limitations of claim 4 as applied above and further shows the platform indicating profile updates to the plurality of windows (see Chandley, [0005], [0038]-[0043]).
Regarding claim 6, the combination shows the limitations of claim 4 as applied above and further shows wherein determining the priorities of the plurality of windows is a window management service of the platform determining the priorities of the plurality of windows (See Chandley, [0034]-[0036]).
Regarding claim 7, the combination shows the limitations of claim 1 as applied above and further shows wherein checking whether resource re-allocation is needed according to the performance indexes is checking whether resource re-allocation is needed according to frames per second (FPS), hardware loading and/or thermal status (see Swedberg, [0023], [0029]).
Regarding claim 8, the combination shows the limitations of claim 1 as applied above and further shows wherein the profiles include resolution and frame rate (see Chandley, [0011], [0043]).
Regarding claim 9, the combination shows the limitations of claim 1 as applied above and further shows wherein changing the profiles of the targets according to the resource re-allocation algorithm comprises lowering profiles of windows other than a primary window until the performance indexes meet predetermined criteria (see Chandley, [0038]-[0043]).
Regarding claim 10, the combination shows the limitations of claim 9 as applied above and further shows wherein changing the profiles of the targets according to the resource re-allocation algorithm further comprises if the profiles of the windows other than primary window reach basic criteria, lowering profiles of the primary window (see Chandley, [0037], [0050]).
