The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This is in response to Application filed 08/05/24. Claims 1 – 20 have been examined and are pending.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 – 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Giri et al. 20200356358 A1.
Regarding claim 1, Giri anticipates a method comprising:
providing input firmware image data to a patch generator [0029, see several patch images being generated and applied to patch image, 0026 shows being applied to firmware];
producing, by the patch generator, a set of upgrade instructions for a piece of
target endpoint hardware in a power distribution network based on the firmware image
data, wherein the set of upgrade instructions are constructed and arranged to facilitate a
modification of a current firmware installation of the target endpoint hardware based on
the firmware image data [0026, see custom build and firmware];
producing, by the patch generator, a set of script instructions for a piece of target
endpoint hardware, the script instructions including a compatibility script, a program script, and an audit script; and, executing, by the target endpoint hardware, the set of upgrade instructions and the script instructions [0039, see comprising a script].
Regarding claim 2, the method of claim 1, wherein the upgrade instructions, when executed by a network interface card, produce an upgrade file for the target endpoint hardware [0006, see full image upgrade].
Regarding claim 3, the method of claim 2, wherein the firmware image data is provided by:
receiving, by the patch generator, a desired firmware image [0031, see patched image is received];
producing, by the patch generator, the firmware image data based on the desired
firmware image [0029, see several patch images being generated and applied to patch image, 0026 shows being applied to firmware];
producing, by the patch generator, formatted upgrade instructions by inserting the
set of upgrade instructions into a schema [0017, see modified and re-formatted]; and,
producing, by the patch generator, upgrade packets by packetizing the formatted
upgrade instructions [0017].
Regarding claim 4, the method of claim 3, wherein the target endpoint hardware is a meter, the method further comprising:
producing, by the network interface card, a target endpoint hardware upgrade file
based on the upgrade packets [0020, shows using packet]; and,
communicating, by the network interface card, the upgrade file to the meter [0038].
Regarding claim 5, the method of claim 4, wherein the compatibility script is configured to cause the network interface card to execute commands to confirm a compatibility of the meter with a received target endpoint hardware configuration schema [0038].
Regarding claim 6, the method of claim 5, wherein the program script is configured to cause the network interface card to execute commands to prepare the meter for a change to a current configuration of the meter, and to perform changes to its current configuration [0038 – 0039].
Regarding claim 7, the method of claim 6, wherein the audit script is configured to cause the network interface card to execute data table commands that confirm changes embodied in the program script were effective [0054 – 0055, see network and write program code].
Regarding claims 8 and 15, Giri anticipates a patch generator, configured to:
receive firmware image data; produce a set of upgrade instructions for a piece of target endpoint hardware in a
power distribution network based on the firmware image data [0026, see custom build and firmware];
wherein the set of upgrade instructions are constructed and arranged to facilitate a modification of a current firmware installation of the target endpoint hardware based on the firmware image data [0029, see several patch images being generated and applied to patch image, 0026 shows being applied to firmware];
and, produce a set of script instructions for a piece of target endpoint hardware, the
script instructions including a compatibility script, a program script, and an audit script [0039, see comprising a script].
Regarding claims 9 and 16, the patch generator of claim 8, wherein the upgrade instructions, when executed by a network interface card, produce an upgrade file for the target endpoint hardware [0029, see several patch images being generated and applied to patch image, 0026 shows being applied to firmware].
Regarding claim 10, and 17, the patch generator of claim 9, wherein the firmware image data is provided by:
receiving, by the patch generator, a desired firmware image [0031, see patched image is received];
producing, by the patch generator, the firmware image data based on the desired
firmware image [0026 - 0031, see patched image is received];
producing, by the patch generator, formatted upgrade instructions by inserting the set of upgrade instructions into a schema [0026 – 0039] and, producing, by the patch generator, upgrade packets by packetizing the formatted upgrade instructions [0026 – 0031].
Regarding 11 and 18, the patch generator of claim 10, wherein the target endpoint hardware is a meter configured to build the upgrade file based on the upgrade packets[0026 – 0039].
Regarding claim 12, the patch generator of claim 11, wherein the compatibility script is configured to cause the network interface card to execute commands to confirm a compatibility of the meter with a received target endpoint hardware configuration schema [0026 – 0039].
Regarding claim 13 and 19, the patch generator of claim 12, wherein the program script is configured to cause the network interface card to execute commands to prepare the meter for a change to a current configuration of the meter, and to perform changes to its current configuration [0026 – 0039].
Regarding claim 14, and 20, the patch generator of claim 13, wherein the audit script is configured to cause the network interface card to execute data table commands that confirm changes embodied in the program script were effective [0026 – 0039].
