DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claims 1-7, claim 1 recites ‘a second cell orbit type’ It is unclear what ‘a second cell orbit type’ means. That is, how can a cell orbit? It is believed that this should read ‘a second orbit type’ which is consistent with ‘a first orbit type’. Claims 2-7 do not cure the deficiencies of claim 1 and are rejected for similar reasons. Regarding claims 2-4, claim 2 recites ‘an NTN power sharing condition’ It is unclear if this is the same condition mentioned in claim 1 ‘an NTN power sharing status condition’ or some other condition. Claims 3-4 do not cure the deficiencies of claim 2 and are rejected for similar reasons. Claim 4 in particular uses the same terminology. Please clarify. Regarding claims 8-14, claim 8 recites ‘a second cell orbit type’ It is unclear what ‘a second cell orbit type’ means. That is, how can a cell orbit? It is believed that this should read ‘a second orbit type’ which is consistent with ‘a first orbit type’. Claims 9-14 do not cure the deficiencies of claim 8 and are rejected for similar reasons. Allowable Subject Matter Claims 1 and 8 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 2-7, 9-14 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Roy (2023/0102334) discloses in fig.7 receiving LEO satellite assistance information and performing measurements over candidate cells for cell reselection Xu (2023/0269635) discloses in fig. 10 and para. 88 selecting an NTN cell based upon a ranking of suitable cells and additional parameters like GEO, LEO, etc. Lauridsen (2025/015961) discloses in fig. 3 cell shutdown indication.
