In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.

Regarding claims 10 and 18, Liu discloses the information element is carried in at least one of a management or action frame, a spatial consistency sounding (SCS) request frame, an SCS response frame, or an individually addressed frame. Regarding claim 19, Liu discloses the first AP comprises at least one of a hardware AP, a soft AP, or a peer-to-peer station (STA). Claim Rejections - 35 USC § 103

A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.

Claim(s) 2-6 and 12-15 are rejected under 35 U.S.C. 103 as being unpatentable over Liu in view of Huang (Pub. No. US 2025/0227537 A1; hereinafter Huang).

The motivation to combine is QoS characteristics element is carried, it indicates that the transmitting end has a QoS requirement for the corresponding SCS stream, and needs to negotiate with the receiving end, or the receiving end needs to perform a measure such as optimization and improvement based on QoS measurement data of the SCS stream (See 0132).

It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the method and system disclosed by Liu to include exchange a scheduled quiet time period with BSSID. The motivation to combine is to reduce interference caused by overlapping BSS (See 0004).
Claim(s) 8-9 and 17 are rejected under 35 U.S.C. 103 as being unpatentable over Liu in view of Ajami et al. (Pub. No. US 2024/0292456 A1; hereinafter Ajami).
