Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Drawings
The drawings are objected to because the claimed “concave space” is not provided with a reference number in the drawings. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-15 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 20180084907(“Chen et al.”).
Regarding Claims 1-10, Chen et al. discloses CLAIM 1- a slide rail kit, configured to be mounted to a rack (20) having a first side frame and a second side frame, the slide rail kit comprising: a first rail (22) having an outer side and an inner side; a second rail (68) longitudinally movable relative to the first rail (22) and adjacent (taken to mean close) to the inner side of the first rail (22); and a bracket device (48, 70) arranged on the first rail (22); wherein a recessed structure (opening behind 64) is formed at the outer side of the first rail (22) and recessed toward the inner side of the first rail (22), and a concave space is defined by the recessed structure (opening behind 64); wherein the first rail (22) is configured to be mounted to the first side frame of the rack through the bracket device (48, 70), and the recessed structure (opening behind 64) of the first rail (22) is configured to allow a predetermined part of the first side frame of the rack (20) to extend into the concave space (via 37); CLAIM 2-further comprising a third rail (66) movably mounted between the first rail (22) and the second rail (68); wherein the first rail (22) comprises a first wall, a second wall and a longitudinal wall connected between the first wall and the second wall, and a passage is defined by the first wall, the second wall and the longitudinal wall of the first rail (22) to accommodate the third rail (66); CLAIM 3- wherein the recessed structure (opening behind 64) is partially formed on the longitudinal wall and located at the outer side of the first rail (22); CLAIM 4-wherein the recessed structure (opening behind 64) is partially formed on at least one of the first wall and the second wall of the first rail (22); CLAIM 5- wherein the recessed structure (opening behind 64) is formed on a predetermined rail section of the first rail (22); CLAIM 6- wherein the longitudinal wall has a plurality of first surfaces (at each side of recess) and a second surface (lower sides) at the outer side of the first rail (22), and the second surface is located between the first surfaces; wherein the first surface and the second surface are spaced apart from each other by a transverse distance along a transverse direction of the slide rail kit, and the concave space is formed above the second surface (under the recess); CLAIM 7- wherein the first surface and the second surface are located at different transverse positions along the transverse direction of the slide rail kit; CLAIM 8- wherein the longitudinal wall of the first rail comprises a first longitudinal section (left side), a second longitudinal section (right side) and a rib (53) connected between the first longitudinal section and the second longitudinal section; each of the first longitudinal section and the second longitudinal section has the first surface, and the rib has the second surface; CLAIM 9-wherein the first rail (22) has a first end part and a second end part opposite to each other; wherein the recessed structure (opening behind 64) is located adjacent to one of the first end part and the second end part; CLAIM 10- wherein the first side frame of the rack comprises at least one post (S1), and the bracket device (48, 70) is configured to be mounted to the at least one post.
Regarding Claims 11-15, Chen et al. discloses CLAIM 11 a slide rail kit, comprising: a first rail (22) having an outer side; and a bracket device (48, 70) arranged on the first rail (22) and comprising a rack mounting feature; wherein a recessed structure (opening behind 64) is formed at the outer side of the first rail (22) and adjacent to a lateral side of the rack mounting feature; CLAIM 12- wherein the first rail (22) has an inner side opposite to the outer side; wherein the slide rail kit further comprises a second rail (68) longitudinally movable relative to the first rail (22) and adjacent to the inner side of the first rail (22); wherein the bracket device (48, 70) comprises a bracket (70) arranged with the rack mounting feature; CLAIM 13-, wherein the bracket (70) is movable relative to the first rail (22); wherein when the bracket (70) is located at a mounting position relative to the first rail (22), the recessed structure (opening behind 64) at the outer side of the first rail (22) is located adjacent to the lateral side of the rack mounting feature of the bracket; CLAIM 14- wherein the first rail (22) comprises a first wall, a second wall and a longitudinal wall connected between the first wall and the second wall; wherein the recessed structure (opening behind 64) is formed on the longitudinal wall at the outer side of the first rail (22) and recessed toward the inner side of the first rail (22), and a concave space is defined by the recessed structure (opening behind 64); wherein the longitudinal wall has a plurality of first surfaces (at each side of the recess) and a second surface at the outer side of the first rail (22), and the second surface is located between the first surfaces (under the recess); wherein the first surface and the second surface are spaced apart from each other by a transverse distance along a transverse direction of the slide rail kit, and the concave space is formed above the second surface; CLAIM 15-wherein the first surface and the second surface are located at different transverse positions along the transverse direction of the slide rail kit.
