Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-2, 6-7, 11-12, and 16-17 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Elshafie et al (2024/0098642).
Regarding claims 1 and 11, Elshafie discloses a user equipment (UE) and a method performed by the UE (see UE in figures 3 and 5) in a wireless communication system, the method comprising: receiving, from a base station (501 in figure 5), configuration information related to a time-domain position of a signal (see configuration and time domain in figures 7 and 8A-8D); identifying a time-domain position of a first signal according to the configuration information, the first signal being used for at least one of synchronization or a radio resource management (RRM) measurement (see apparatus at a first network entity (such as a user equipment (UE)) are provided. The apparatus may include a first radio and a second radio coupled to the first radio. The first radio may be configured to receive, from a second network entity, one or more low power (LP) reference signal (LP RS) resources, where the one or more LP RS resources are configured for at least one of: time or frequency tracking or synchronization, time or frequency error estimation or correction, radio resource management (RRM) (e.g., serving cell or non-serving cell RRM) in paragraph 0005); and identifying a time-domain position of a monitoring occasion for a second signal based on the time-domain position of the first signal, the second signal being used for a wake-up (see The first radio may be configured to receive (e.g., from the second network entity) a LP wake up signal (LP WUS) based on the one or more LP RS resources, where the LP WUS is associated with one or more monitoring occasions in paragraph 0005).
Regarding claims 2 and 12, Elshafie discloses the first signal and the second signal are wake up signals (see The term “LP WUS” may refer to a signal received via a LP WUR that is used for waking up the MR and may be associated with a paging early indication, an idle discontinuous reception (DRX) cycle (e.g., associated with paging monitoring occasions) during RRC idle mode/state, a discontinuous reception (DRX) cycle (e.g., associated with paging monitoring occasions) during RRC inactive mode/state, wake up monitoring occasions associated with a connected-mode DRX cycle, or the like in paragraphs 0082; The UE may include a first radio or a second radio. In some aspects, the first radio is a low power wake up radio and the second radio is a main radio in paragraph 0095).
Regarding claims 6-7 and 16-17, claims 6-7 and 16-17 claim a based station and a method performed by the base station that is in communication with the user equipment claimed in claims 1-2 and 11-12. Claims 6-7 and 16-17 are, therefore, subject to the same rejection.
Allowable Subject Matter
Claims 3-5, 8-10, 13-15, and 18-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
