Notice of Pre-AIA or AIA Status
This office action is in response to the amendment filed 7/07/26. Claims 1, 3-6 and 8-14 are pending. Claims 2 and 7 have been canceled. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
The new title is approved.
The information disclosure statement (IDS) submitted on 8/28/26 is mostly in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement has been considered by the examiner. No date was provided for NPL cite 1, as such, it has been lined out.
The replacement drawing sheet has been entered and overcomes the objection set out in section 5 of the last office action. The amendment to claim 13 overcomes the objection set out in section 6 of the last office action.
The new drawing sheet has been entered.
The disclosure is objected to because of the following informalities: there is no brief description of new figure 56.
Appropriate correction is required.
Claims 1, 3-6 and 8-14 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-17 of U.S. Patent No. 12,084,879. Although the claims at issue are not identical, they are not patentably distinct from each other because the subject matter of the instant claims is included within the patent claims. Note particularly claim 7 which includes the limitations added by the most recent amendment.
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
