The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
Acknowledgment is made of applicant's claim for foreign priority based on an application filed in Republic of Korea on 08/17/2023. It is noted, however, an attempt by the office to electronically retrieve the foreign application 10-2023-0107508 to which priority is claimed has FAILED on 01/17/2025.
Information Disclosure Statement
The information disclosure statement (IDS) submitted on 11/03/2025 and 08/08/2024 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 18 recites the limitation "the moving path" in line 1. There is insufficient antecedent basis for this limitation in the claim.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 6, 17 and 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by ZHU (US Patent Appl. Pub. No. 2020/0411696 A1).
[Re claim 1] ZHU discloses the thin film transistor substrate, comprising: a substrate (1); an active layer (2) on the substrate and including an active hole (23); and a gate electrode (4) on the active layer, wherein the active layer (2) includes a channel part including a first channel part (edge part of 22) having a first length and a second channel part (middle part of 22) continuous with the first channel part and having a second length, and wherein the active hole includes a first active hole (23) at a boundary portion between the first channel part and the second channel part (see figure 2-3 and paragraphs [0038]-[0067]).
[Re claim 6] ZHU discloses the thin film transistor substrate wherein the first active hole extends in a second direction and does not overlap an end of the active layer (see figure 4 and paragraph [0049]-[0050]).
[Re claim 17] ZHU discloses the thin film transistor substrate, comprising: a substrate (1); an active layer (2) on the substrate; and a gate electrode (4) on the active layer, wherein the active layer includes a first channel part (edge part of 22) overlapping the gate electrode and having a first length, and a second channel part (middle part of 22) continuous with the first channel part, overlapping the gate electrode, and having a second length, and wherein the active layer includes an active hole (23) so that carrier does not move from the second channel part to the first channel part (see figure 2-3 and paragraphs [0038]-[0067]).
[Re claim 20] ZHU discloses the display device including the thin film transistor substrate, comprising: a substrate (1); an active layer (2) on the substrate and including an active hole (23); and a gate electrode (4) on the active layer, wherein the active layer includes a channel part including a first channel part (edge part of 22) having a first length and a second channel part (middle part of 22) continuous with the first channel part and having a second length, and wherein the active hole includes a first active hole at a boundary portion between the first channel part and the second channel part (see figure 2-3 and paragraphs [0038]-[0067]).
Allowable Subject Matter
Claim 2-5, 7-16 and 19 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
