DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-3, 5-8, and 10-16 are rejected under 35 U.S.C. 103 as being unpatentable over Holzer et al (US 20180338847 A1) “Holzer”.
Regarding Claim 1, the first embodiment of Holzer teaches a method for producing a living body indwelling object (par. [0002]), comprising:
disposing a porous structure (porous structure 104, par. [0137], Fig. 1) having a large number of penetrating voids (apertures 110, par. [0148], Fig. 1) and a porous structure fixing material (par. [0199], polymer coating the supporting element) on a stent (support element 102, par. [0136], Fig. 1), the stent extending in an axial direction and configured to be inflatable in a radial direction (central axis 106, par. [0136], Fig. 1), but does not disclose fixing the porous structure to the stent by melting the porous structure fixing material. However, another embodiment of Holzer discloses fixing the porous structure to the stent by melting the porous structure fixing material (par. [0199]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include fixing the porous structure to the stent by melting the porous structure fixing material, as taught by another embodiment of Holzer, in order for the stent assembly to effectively deliver the necessary treatment to tissues (par. [0030]).
Regarding Claim 2, the main embodiment of Holzer further teaches the method for producing a living body indwelling object according to claim 1, wherein the porous structure includes a mesh having a knitted stitch structure, and the porous structure fixing material includes a mesh fixing material (pars. [0023], [0148], and [0149]).
Regarding Claim 3, the main embodiment of Holzer does not disclose disposing the porous structure on a surface of the porous structure fixing material. However, another embodiment of Holzer discloses disposing the porous structure on a surface of the porous structure fixing material after the porous structure fixing material is disposed on the stent (par. [0199]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include disposing the porous structure on a surface of the porous structure fixing material, as taught by another embodiment of Holzer, in order for the stent assembly to effectively deliver the necessary treatment to tissues (par. [0030]).
Regarding Claim 5, the main embodiment of Holzer does not disclose embedding the porous structure in the porous structure fixing material. However, another embodiment of Holzer teaches embedding the porous structure in the porous structure fixing material (par. [0187] and [0226]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include embedding the porous structure in the porous structure fixing material, as taught by another embodiment of Holzer, in order for the stent assembly to effectively deliver the necessary treatment to tissues (par. [0030]).

However, another embodiment of Holzer teaches the porous structure fixing material is formed of a material selected from a group consisting of a polymer and a wax (par. [0199]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include disclose the porous structure fixing material formed a polymer and a wax, as taught by another embodiment of Holzer, in order to have a material with the appropriate structure to prevent blood from passing through the device to prevent further expansion of the aneurysm (par. [0026]).
Regarding Claim 7, the main embodiment of Holzer does not disclose the porous structure fixing material with a melting point lower than a melting point of a material constituting the porous structure. However, another embodiment of Holzer teaches a material constituting the porous structure fixing material has a melting point lower than a melting point of a material constituting the porous structure (pars. [0192] and [0199], fixing material melting point may be at or below porous structure melting point). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include the porous structure fixing material with a melting point lower than a melting point of a material constituting the porous structure, as taught by another embodiment of Holzer, in order for the stent assembly to effectively deliver the necessary treatment to tissues (par. [0030]).
Regarding Claim 8, the main embodiment of Holzer does not disclose disposing the porous structure fixing material on a part of the stent. However, another embodiment of Holzer teaches disposing the porous structure fixing material on a part of the stent (par. [0199]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include disposing the porous structure fixing material on a part of the stent, as taught by another embodiment of Holzer, in order for the stent assembly to effectively deliver the necessary treatment to tissues (par. [0030]).
Regarding Claim 10, the main embodiment of Holzer does not disclose a drug coating layer and an exposed portion disposed with the fixing material. It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include melting the porous structure fixing material using a laser, a light beam, heat, and/or ultrasounds, as taught by another embodiment of Holzer, in order to effectively secure the device components (par. [0199]).
Regarding Claim 15, the main embodiment of Holzer does not disclose the pressing body having a laser light transmission property. However, another embodiment of Holzer teaches the method for producing a living body indwelling object according to claim 12, wherein

irradiating the porous structure fixing material is irradiated with laser light via the pressing body (pars. [0190] and [0202]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by the first embodiment of Holzer to include the pressing body having a laser light transmission property, as taught by another embodiment of Holzer, in order to effectively secure the device components (par. [0199]).

[0089], Fig. 2) that connect the plurality of rings through the gaps, and the method further comprises:
disposing the porous structure fixing material on at least one of the plurality of link portions (pars. [0160] and [0161]). It would have been obvious to one of ordinary skill in the art, before the effective filing date of the claimed invention, to modify the structure disclosed by Holzer to include a plurality of linear rings that connect through link portions, as taught by von Oepen, in order to have varied position, distribution density, and thickness of these pluralities of connection elements that allows for device adjustments (von Oepen, par.
