The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This Action is responsive to the Continuation Application filed on 8/13/2024 (effective filing date 7/31/2013). Claims 41-70 are pending in the case.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 41-70 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
Claim 1 recites displaying a first alternative image, indicating a third application in a hide mode, overlapping the full-sized window, the first alternative image being smaller than the sub-window;
detecting a first touch gesture, for requesting release of the hide mode, on the first alternative image; and
based on the first touch gesture, for requesting release of the hide mode, being detected on the first alternative image, displaying, instead of displaying the second application on the sub-window, the third application on the sub-window and displaying, instead of displaying the first alternative image, a second alternative image overlapping the full-sized window, the second alternative image being smaller than the sub-window, wherein the second alternative image indicates the second application in the hide mode.
There is no mention in the original specification of these limitations. Specifically, the specification does not describe simultaneously displaying a third application in a “hide mode” and/or an alternative image for a third application in a “hide mode”, a first application on a full-sized window, and a second application on a sub-window. In other words, there is no mention of a third application in a “hide mode” at all. Thus, the limitations include subject matter that was not described in the original specification.
If the examiner has overlooked the portion of the original specification that describes these features, then applicant should point it out in the response to this office action.
