Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1, 14, 23, 28 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Babaei (Pub. No. 20240267987).
- With respect to claims 1, 14, 23, 28, Babaei teaches a user equipment (UE) for wireless communication, comprising: one or more memories; and one or more processors, coupled to the one or more memories, configured to cause the UE to: receive a configuration of cell discontinuous transmission or cell discontinuous reception (e.g. Fig. 17 shows Wireless device receives configuration parameter of Cell DTX and/or DRX); receive a configuration of carrier aggregation associated with a primary cell (Pcell) and a secondary cell (Scell) (e.g. Fig. 11A and B shows the carrier aggregation associated with Pcell and Scell); receive an indication to activate or deactivate the cell discontinuous transmission or cell discontinuous reception for the Pcell (e.g. Fig. 17 shows the L1, L2 command); and skip, or monitor for, based at least in part on the indication to activate or deactivate the cell discontinuous transmission or cell discontinuous reception for the Pcell (e.g. the activate/ deactivate a first DTX, and/ or DRX), reception or transmission of one or more channels associated with the Scell (Fig. 22 shows DRX/DTX pattern comprising plurality of bits that is for activate/ deactivate and reception or transmission. See par. 237).
Allowable Subject Matter
Claims 2-13, 15-22, 24-27, 29-30 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. See PTO-892.
