This is the first Office Action for the serial number 18/805,580, CHILD SAFETY SEAT WITH ROTATING MECHANISM, filed on 8/15/24.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1, line 13, “the driving mechanism is controlled to be unable to start.” is indefinite because it is not clear what the applicant meant by “start”, start rotating the seat body? It should be changed to ---the driving mechanism is controlled to be unable to start rotating the seat body--- for clarification.
Claim 6, line 5, “sense opening of a vehicle door and control the seat body to automatically turn to the opened” is indefinite because it is not clear how the first sensing device has the ability of controlling the seat body. The rotating mechanism in the base has the ability of controlling the seat body. It should be changed to ---sense opening of a vehicle door and control the rotating mechanism to automatically turn the seat body to the opened--- for clarification.
Claim 6, line 8, “the rotating mechanism is controlled to be powered off.” should be changed to ---the rotating mechanism is controlled to be powered off to prevent rotating the seat body.--- for clarification.
Claims 2-5 are rejected as depending on rejected claim 1. Claims 7-9 are rejected as depending on rejected claim 6.
Allowable Subject Matter
Claims 1-9 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is an examiner’s statement of reasons for allowance: Regarding claim 1, the prior arts fail to teach all of the limitations from claim 1 especially with “the sensor is configured to sense a state of the locking member; and if the sensor detects that the locking member is unlocked, the driving mechanism is controlled to be unable to start”.
Regarding claim 6, the prior arts fail to teach all of the limitations from claim 6 especially with “if the second sensing device detects that there is a child on the seat body, the rotating mechanism is controlled to be powered off.”
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
