Office Action

§102 §103 §DOUBLEPATENT
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION 1. This action is responsive to the application filed on August 20, 2024. 2. Claims 1-20 have been examined. Double Patenting Rejection 3. The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the "right to exclude" granted by a patent and to prevent possible harassment by multiple assignees. See In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); and In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321 (c) may be used to overcome an actual or provisional rejection based on a nonstatutory double patenting ground provided the conflicting application or patent is shown to be commonly owned with this application. See 37 CFR 1.131 (c). A registered attorney or agent of record may sign a terminal disclaimer. The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/forms/. The filing date of the application will determine what form should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/process/ file/efs/guidance/eTD-info-l.jsp. Claims 1-20 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims of U.S. Patents 11,775,379 and 12,093,127. Although the claims at issue are not identical, they are not patentably distinct from each other (the claims under examination are anticipated by the reference claims) because claims of the present application are just broader versions of the patent claims. Claim Rejections – 35 USC §102 4. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 5. Claim Rejections – 35 USC §103 6. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102 of this title, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. 7. Claim 5 is rejected under 35 U.S.C. 103 as being unpatentable over Franke in view of US 2014/0157040 to Bennah et al. (hereafter “Bennah”). Claim 5. Franke does not disclose the non-transitory, processor-readable medium of claim 1, wherein the metric includes at least one of a central processing unit efficiency, a load amount, or a network traffic amount. However, Bennah discloses the metric includes at least one of a central processing unit efficiency, a load amount, or a network traffic amount (0034). It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to combine Bennah’s teaching into Franke‘s teaching. One would have been motivated to do so to detect irregularity of system health as suggested by Bennah (0034). 8. Claim 10 is rejected under 35 U.S.C. 103 as being unpatentable over Franke in view of US 2017/0147322 to Vopni et al. (hereafter “Vopni”). Claim 10. Franke does not disclose the non-transitory, processor-readable medium of claim 1, wherein each electronic device from the plurality of electronic devices is associated with a common organization having associated users that operate the plurality of electronic devices. However, Vopni discloses each electronic device from the plurality of electronic devices is associated with a common organization having associated users that operate the plurality of electronic devices (0055). It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to combine Vopni’s teaching into Franke‘s teaching. One would have been motivated to do so to fix firmware defects of devices manufactured by a specific manufacture in an enterprise as suggested by Vopni (0055). 9. Claim 15 is rejected under 35 U.S.C. 103 as being unpatentable over Franke in view of US 2022/0413993 to Farinas et al. (hereafter “Farinas”). Claim 15. Franke does not disclose the apparatus of claim 11, wherein the processor is further configured to: determine a confidence score that indicates a confidence of the anomaly being present and that is based on the first set of statistical properties and the second set of statistical properties. However, Farinas discloses determine a confidence score that indicates a confidence of the anomaly being present and that is based on the first set of statistical properties and the second set of statistical properties (0028, 0056). It would have been obvious to a person having ordinary skill in the art before the effective filing date of the claimed invention to combine Farinas’ teaching into Franke‘s teaching. One would have been motivated to do so to flag firmware revision having higher threshold of error than standard deviations as suggested by Farinas (0028, 0056). Allowable Subject Matter 10. After search and analysis, Examiner concluded that the claimed invention has been recited in such a manner that dependent claim 6 is not taught by any prior reference found through search. The primary reason for allowance of the claims in this case, is the inclusion of the limitations “The non-transitory, processor-readable medium of claim 1, wherein: the first set of statistical properties includes (1) a mean value of the first set of values and (2) a standard deviation value of the first set of values; and the second set of statistical properties includes (1) a mean value of the second set of values and (2) a standard deviation value of the second set of values,” which are not found in the prior art of record. Incorporating claim 6 into claims 1, 11, and 16 would put the case in condition for allowance. Conclusion 11.
