Restriction-Election/Status of claims
On 5/13/2026, the applicant elected SNV1 for Election 1, InDel4 for Election 2, and the combination of SNV1, InDel4, and SNV95 for Election 3, without traverse.
Up on further consideration, SNV1, InDel4, and SNV95 are examined individually and as a combination.
In summary, claims 1-7 are pending and examined in this office action. Non-elected species are withdrawn.
Priority
Instant application 18810533, filed 08/21/2024, is a Continuation of PCT/JP2023/006427, filed 02/22/2023, and claims foreign priority to 2022-027284, filed 02/24/2022.
The certified copy of the foreign priority was received, but an English translation is missing.
Thus, the priority date of 2/14/2022 is not recognized until the English translation is received.
Claim Objections
Claims 1 and 7 are objected to because:
The independent claims recite “a chromosome Nt09 in a reference genome sequence of K326 of Nicotiana tabacum”.
According to 37 CFR 1.57, the incorporation of essential material by reference to an unpublished U.S. application, foreign application or patent, or to a publication is improper.
According to Nicotiana tabacum genome assembly ASM71507v2 - NCBI - NLM (PDF also attached), genome sequence of K326 of Nicotiana tabacum has different versions, currently the updated version is version 2. Version 1 is different from version 2.
Accordingly, “a chromosome Nt09 in a reference genome sequence of K326 of Nicotiana tabacum” or “a reference genome sequence of K326 of Nicotiana tabacum” are modifiable in content and thus not static sources of information.
Appropriate corrections are required.
The most reliable static information is SEQ ID NOs in a sequence listing.
Claim 1 is objected for following informalities:
In the claim, “SNV”, “Nt09”, “InDel” appear in a claim for the first time. Each of the full names should be recited, followed by the abbreviation in a ().
In addition, the following suggestions are made for correcting informalities:
It is suggested to recite --- tobacco cultivar Matsukawa --- instead of the “Matsukawa”.
It is suggested to recite --- tables 1-2 below --- instead of the “tables below”.
In the 3rd para, the “markers” should be --- the markers ---.
In the 5th para, the “InDel” should be in plural form: --- insertions/deletions (InDels) ---.
In the last para, the “insertion/deletion” should be --- each of the InDels ---.
Claims 1 and 7 are objected for following informalities:
In the claims, the “a chromosome Nt09” should be --- the chromosome Nt09 ---.

Appropriate correction is required.

Claim Rejections - 35 USC § 112
Enablement/Lacking Deposit
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
Claims 1-7 are rejected under 35 U.S.C. 112(a), as failing to comply with the enablement requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to enable one skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention.
As analyzed below in the 112(b) rejection, by BRI cultivar Matsukawa (Kanto) is interpreted as cultivar Matsukawa, of all types and variations.
Claims are drawn to methods of using (to develop new tobacco cultivars), and resultant products, of tobacco cultivar Matsukawa.
By the examiner’s search, only Nicotiana tabacum (also called common tobacco) cultivar K326 has been partially sequenced. See Nicotiana tabacum genome assembly ASM71507v2 - NCBI - NLM. PDF also attached.
Tobacco cultivar Matsukawa, or cultivar Matsukawa Kanto, is not a new cultivar, but had/has not been deposited, sequenced, or characterized, at least for low reversion type low nornicotine content. The specification does not provide deposit information, or sequence (even partial sequence) of cultivar Matsukawa.
Thus, cultivar Matsukawa appears to be a newly characterized biological material. Since the seed of cultivar Matsukawa is essential to the claimed invention, it must be obtainable by a repeatable method set forth in the specification or otherwise be readily available to the public. If a seed is not so obtainable or available, a deposit thereof may satisfy the requirements of 35 U.S.C. 112. The specification does not disclose a repeatable process to obtain the exact same seed in each occurrence and it is not apparent if such a seed is readily available to the public.
If the deposit has been made under the terms of the Budapest Treaty, then a statement, affidavit or declaration by Applicants, or a statement by an attorney of record over his or her signature and registration number, or someone empowered to make such a statement, stating that the specific strain has been deposited under the Budapest Treaty and that the strain will be irrevocably and without restriction released to the public upon the issuance of a patent, and will be publicly available for the enforceable life of the patent, would satisfy the deposit requirement made herein.
If the deposit has not been made under the Budapest Treaty, then in order to certify that the deposit meets the criteria set forth in 37 C.F.R. 1.801-1.809 and MPEP 2402-2411.05, Applicants may provide assurance of compliance by statement, affidavit or declaration, or by someone empowered to make the same, or by a statement by an attorney of record over his or her signature and registration number, showing that
(a) during the pendency of the application, access to the invention will be afforded to the Commissioner upon request;
(b) all restrictions upon availability to the public will be irrevocably removed upon granting of the patent for the enforceable life of the patent in accordance with 37 CFR § 1.808(a)(2);
(c) the deposit will be maintained in a public depository for a period of 30 years or 5 years after the last request or for the enforceable life of the patent, whichever is longer; and
(d) the viability of the biological material at the time of deposit will be tested (see 37 CFR 1.807).
In addition, the deposit information set forth in 37 CFR 1.809(d) should be added to the specification. See 37 C.F.R. 1.801-1.809 for additional explanation of these requirements.
Alternatively, the applicant can provide sequence information, in form of SEQ ID NO(s), at least partial sequences as markers or primers, that are sufficient to distinguish cultivar Matsukawa from common tobacco, and all other tobacco cultivars, and are readily searchable and usable, for one skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention. See MPEP 2164.
Note: regarding claim 7, by examiner’s search, SEQ ID NO: 2, and its encoding sequence, had been taught in the art (multiple references) as a sequence of Nicotiana tabacum/common tobacco. Thus, SEQ ID NO: 2 does not distinguish cultivar Matsukawa from common tobacco, or any other tobacco cultivars. Additional sequences, markers or primers, are required. See “Sequence Matches” (at least 86 duplicates of 100% identical) at the end of office action.
Indefiniteness
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-7 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
There are multiple issues:
Claims recite a term “Matsukawa (Kanto)”, multiple claims, multiple times.
According to Arai et al (The origin and distribution of ‘Kokubu’-type splice-site mutations of the MLO genes in tobacco varieties. Breeding Science 72: 248-256, 2022, not prior art), there are at least 2 known cultivars named Matsukawa, Matsukawa Kanto and Matsukawa Ohkoshichikanari (p251-252, Table 2).
A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) is considered indefinite, since the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c).
In the present instance, claims recite the broad recitation Matsukawa, and the claims also recite Kanto in ()s, which is the narrower statement of the range/limitation. In another word, the “(Kanto)” is narrower than and is a species of “Matsukawa”. It is unclear if the “(Kanto)” means to be Matsukawa Kanto or means to be an example of Matsukawa, or means to be a claim requirement. The metes and bounds are unclear.
Appropriate corrections and clarifications are required.
Dependent claims do not cure the deficiency.
For compact prosecution, by BRI, cultivar “Matsukawa (Kanto)” has to be interpreted as cultivar Matsukawa. If the applicant clearly intends to mean Kanto, it is recommended to recite --- cultivar Matsukawa Kanto ---.
Independent claims 1 and 7 recites “wherein markers indicated by SNV are each a marker based on single nucleotide variation present at a position corresponding to each shown position on a chromosome Nt09 in a reference genome sequence of K326 of Nicotiana tabacum, a "Base" indicates a base in Matsukawa (Kanto), markers indicated by InDel are each a marker based on insertion or deletion present at a position corresponding to each shown position on the chromosome Nt09 in the reference genome sequence, and "Insertion/Deletion" indicates whether the insertion or the deletion is present or not in Matsukawa (Kanto).
By the examiner’s search, the SNVs (SNV1 and SNV95 are elected) in Tables 1 and 3, and the InDels (InDel4 is elected) in Tables 2 and 4, do not generate any meaningful search results in the art.
As analyzed above, the specification does not provide any sequences, deposit, not even a version of the “reference genome sequence of K326 of Nicotiana tabacum”. Hence, the “positions on Nt09” and the “Base” in Tables 1 and 3 do not have clear meanings. The “positions on Nt09” and the “insertion/deletion” in Tables 2 and 4 also do not have clear meanings.
As a result, the SNVs in Tables 1-3 and the InDels in Tables 2-4, are not art searchable and are not clearly defined by the specification. Therefore, they do not have art recognized meanings.
Appropriate corrections and clarifications are required for one skill in the art to make and use the claimed invention.
Dependent claims do not cure the deficiencies.
Claim 1 recites “at least one marker which is of Matsukawa (Kanto), which is selected from tables below, and which allows Matsukawa (Kanto) to be distinguished from the another variety or the mutant of the another variety, wherein markers indicated by SNV are each a marker based on single nucleotide variation present at a position corresponding to each shown position on a chromosome Nt09 in a reference genome sequence of K326 of Nicotiana tabacum”. Claims 5 and 7 have similar recitations.
The examiner notices that
Table 3 differs Table 1 by excluding SNVs 1, 3, 6, 13-14, 21, 26, 29, 38, 42-43, 46, 48, 54-55, 57-58, 62-66, 68, 71-73, 81, 83, 89-91, and 95 (otherwise includes all other SNVs of Table 1).
Table 4 differs Table 2 by excluding InDels 3, 9, 11, 13-15, 17-18, and 20 (otherwise includes all other InDels of Table 2).
From the context of claim 7, another low nornicotine content tobacco plant (other than Matsukawa) comprises and requires the SNVs and InDels except the exclusions in Tables 3 and 4.
Claim 1 requires that at least one marker, a SNV in Table 1 and a InDel in Table 2, is required to distinguish Matsukawa from the another tobacco.
Thus, Both Matsukawa and tobacco plant (other than Matsukawa) require the the SNVs and InDels except the exclusions in Tables 3 and 4.
In another word, the “at least one marker” recited in claim 1 cannot distinguish Matsukawa from the another tobacco. In another word, the claims are contradicting among themselves.
Appropriate corrections and clarifications are required for one skill in the art to make and use the claimed invention.
Dependent claims do not cure the deficiencies.
Remarks
As analyzed above, claims are deemed indefinite and not enabled. Please also see the prosecution of application 17965450/USP12239090, filed by the applicant Japan Tobacco Inc. SEQ ID NOs are claimed.
