Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1, 8, is/are rejected under 35 U.S.C. 103 as being unpatentable over RUELKE US 20110117854 in view of Etkin US 20160021627.
Regarding claim 1, RUELKE teaches a modulator configured to:
receive the at least one frame; and
generate an I/Q digital signal based on the received at least one frame; and
a wideband digital to analog converter (DAC) configured to:
receive the I/Q digital signal; and
generate an I/Q baseband signal corresponding to the I/Q digital signal (fig. 2 box 246, The transmit baseband I/Q
modulation path, also referred to as the forward I/Q modulation portion of the transmit subsystem, comprises Digital-to-Analog Converter (DAC) 246, tunable filter 244 and summer block 242. DAC 246 is a complex DAC pair for converting digital
information from digital controller 290 into modulation signals, and preferably baseband I/Q transmit modulation signals, [0051]).
Although RUELKE teaches Ethernet ([0015]), the reference is silent on an interface configured to:
receive an Ethernet frame comprising one or more frames; and
send at least one frame of the one or more frames;
a modulator configured to:
receive the at least one frame; and
generate an I/Q digital signal based on the received at least one frame.
Etkin teaches an interface configured to:
receive an Ethernet frame comprising one or more frames; and
send at least one frame of the one or more frames;
a modulator configured to:
receive the at least one frame; and
generate an I/Q digital signal based on the received at least one frame (In another example, the Ethernet packet processing apparatus may generate OFDM I/Q samples from the Ethernet packets 230, assemble the OFDM I/Q samples, training sequences, and pilot sequences into an OFDM frame, and modulate the data bits contained in the Ethernet packets 230, [0033]).
Therefore it would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention, to modify the system of RUELKE by an interface configured to: receive an Ethernet frame comprising one or more frames; and send at least one frame of the one or more frames;
a modulator configured to: receive the at least one frame; and
generate an I/Q digital signal based on the received at least one frame, as shown by Etkin. This modification would benefit the system by enabling the system of RUELKE to process Ethernet packets.
Regarding claims 2, a transmitter configured to receive the I/Q baseband signal, and send a radio frequency (RF) signal based on the I/Q baseband signal (RUELKE: fig. 2 see transmitter element 264).
Regarding claim 3, 9, transmitter comprises:
a baseband filter configured to filter the I/Q baseband signal to generate a filtered I/Q signal (RUELKE: The transmit I/Q modulation path comprises DAC 246, tunable filter
244, [0041]).
Regarding claims 4, 10, the transmitter comprises:
a second modulator, coupled to the baseband filter, the second modulator configured to generate the radio frequency (RF) signal based on the filtered I/Q signal (RUELKE: The transmit
modulator 240, which may also be referred to as a transmitter up-mixer, combines a transmit baseband modulation signal with a LO signal to produced a modulated continuous transmit RF signal, [0052]).
Regarding claims 5, 11, an amplifier configured to amplify the radio frequency (RF) signal (RUELKE: The continuous transmit RF signal from the transmit modulator 240 may be further amplified by a transmitter final output 260 prior to being sent to the antenna switch 206 for routing to the antenna 205, [0052]).
Regarding claim 6, 12, the I/Q digital signal corresponds to a wideband signal, the wideband signal comprising one or more modulated carriers (RUELKE: wideband, [0003]).
Regarding claim 7, 13, the I/Q baseband signal comprises an analog signal at a baseband frequency, the analog signal
comprising an I signal and a Q signal (RUELKE: The transmit baseband I/Q Modulation path, also referred to as the forward I/Q modulation portion of the transmit subsystem, comprises Digital-to-Analog Converter (DAC) 246, tunable filter 244 and summer block 242, [0051]).
Allowable Subject Matter
Claims 15-20 are allowed.
Claim 14 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
