DETAILED ACTION
This is a response to Applicant’s communication filed on August 27, 2024. Application No. 18/815,847, is a Continuation of PCT/JP2023/008501, filed March 7, 2023, and claims foreign priority to Japanese application No. JAPAN 2022-051370, filed March 28, 2022. Claims 1-20 are pending.
Claim Rejections - 35 USC § 102(a)(1)
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-20 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Khapade et al., US2019/0105268 A1. Khapade discloses a composition for a living body (see Khapade et al., US PGpub ‘268, abstract, for a viscoelastic gel composition comprising liraglutide), comprising:
a neutral acyl lipid containing glyceryl oleate; (see Id., para. [0030], for glyceryl monooleate and glyceryl dioleate)
a phospholipid; (see Id., para. [0031] for phosphatidylcholine)
an alcohol having 4 or less carbon atoms or a polyalkylene oxide; (see Id., para. [0034] for propylene glycol) and
a physiologically active substance, (see Id., Abstract for liraglutide)
wherein a content of a neutral diacyl lipid in the neutral acyl lipid is more than 0% by mass and 50% by mass or less, (see Id., para. [0032]-[0033])
a mass ratio of a content of the neutral acyl lipid to a content of the phospholipid is 54/46 to 1/99, (Id.) and
the composition for a living body is for percutaneous absorption or mucous membrane absorption. (See Id., Abstract.)
