Office Action

§102 §103 §DOUBLEPATENT
DETAILED ACTION This office action is responsive to communications filed on August 29, 2024. Claims 1-20 are pending in the application. Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The Information Disclosure Statements filed on 2/10/2026 and 2/11/2026 have been considered. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13. The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/apply/applying-online/eterminal-disclaimer. Claims 1, 3-5, 7-11, 13, 14, 15, 19, and 20 are provisionally rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1, 8, 11, 12, and 15-18 of copending Application No. 18/822,429 (reference application). Xu further teaches receiving, by the first network function instance, an identifier of a sensing node that is sent by a sensing function instance; or, wherein the method further comprises: receiving, by the first network function instance, a measurement result that is of a sensing measurement quantity and that is sent by a sensing node; and sending, by the first network function instance, the measurement result to a sensing function instance (“the request #1 in S702 includes at least one of service type information, area information, and service requirement information of the sensing service” – See [0271]; “The service requirement information may include at least one of the service requirement information: … a first sensing UE identifier” – See [0274]; “S902 may be implemented with reference to S702” – See [0454]; “S903: The SCF sends the request #2 to the CCF based on the request #1. In this application, the request #2 may include a sensing computing request” – See [0456]; “It should be understood that the service type information of the sensing service in the request #2 may be obtained based on service type information of the sensing service in the request #1. For example, the two pieces of service type information are the same” – See [0459]; The CCF (first network function instance) receives a sensing UE identifier (identifier of a sensing node) from the SCF (sensing function instance)). Regarding Claim 18, Xu teaches the method according to claim 11. Xu further teaches that the establishing and/or modifying, by the first network function instance, a sensing data transmission channel based on the sensing QoS information comprises: mapping, by the first network function instance, the received sensing QoS information to one or more sensing data transmission channels (“S904: The CCF determines the first CF based on the request #2 and the first information of the at least one CF” – See [0470]; “S908: The SCF sends information about the first CF to a RAN. The information about the first CF is used by the RAN to send the first sensing data to the first CF” – See [0490]; “the access network device may be a UE corresponding to the access network device” – See [0430]; The CCF determines, based on the received sensing QoS information, a first CF to which the sensing data should be reported by the RAN/UE. Accordingly, a mapping is created between the sensing QoS information and a sensing data channel between the sending device (e.g., RAN/UE) and the CF which receives the sensing data). Claim 19 is rejected based on reasoning similar to Claim 1. Regarding Claim 20, Xu teaches the method of Claim 11. Xu further teaches a communication device, comprising a processor and a memory, wherein the memory stores a program or an instruction that can be run on the processor, and when the program or the instruction is executed by the processor, the steps of the method for implementing sensing QoS according to claim 11 are implemented (“the computing control network element may include a computing control function (computing control NF, CCF) network element” – See [0032]; “the communication apparatus 1200 may be … the computing control network element” – See [0547]; “The processor 1202 executes the application program stored in the memory 1203, to implement the foregoing function, thereby implementing a function of the communication apparatus 1200” – See [0546]). Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim 16 is rejected under 35 U.S.C. 103 as being unpatentable over Xu et al. (US 2024/0422236) in view of Liu et al. (US 2024/0406690). Regarding Claim 16, Xu teaches the method of Claim 11. Xu further teaches that the first network function instance is a session management function (SMF) (“the computing control network element may include a computing control function (computing control NF, CCF) network element” – See [0032]; “computing control network element in this application may alternatively be an SMF network element” – See [0190]; The CCF/computing control function may be an SMF). Xu does not explicitly teach that the sensing data transmission channel is a user plane PDU session; or the first network function instance is a target plane network function instance, the sensing data transmission channel is a target plane data transmission channel, and the target plane is a protocol function plane used to support at least one of data collection, data distribution, data security, data privacy, data analysis, or data preprocessing. However, Liu teaches that the sensing data transmission channel is a user plane PDU session (“The connection may be: a Protocol Data Unit (PDU) connection corresponding to a PDU session that is negotiated to establish based on a PDU session establishment. The sensing data and/or the sensing result are delivered over the PDU connection established based on the PDU session” – See [0182]; The sensing data transmission is performed using a user plane PDU session between the UE and the network). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify Xu such that the sensing data transmission channel is a user plane PDU session. Motivation for doing so would be to provide a connection over which the sensing data/result can be delivered (See Liu, [0178]). Allowable Subject Matter Claim 17 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
