The certified copy has been filed in parent Application No. CN 202210196169.3 , filed on 1 st March 2022 . ---------- ---------- ---------- Information Disclosure Statement The information disclosure statements (IDS) submitted on 2 nd January 2025 and 12 th May 2025 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. ========== ========== ========== Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-03-aia AIA Claim s 23 , 30, 31 , 38, 39 and 44 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Sayana et al (US 2012/0039251 A1) . Claim 31 . (similarly Claims 23 and 39 ) Sayana shows an apparatus (figs. 1 and 2: base station / eNB), comprising: at least one processor coupled to a memory with instructions stored thereon ( eNB must have processor and memory to run ), wherein the instructions, when executed by the at least one processor, enable the apparatus to: generate first indication information, wherein the first indication information indicates a precoding matrix (figs. 3 and 4 and [0030]: the precoding matrix may be signaled by the base unit efficiently with a precoding matrix index (PMI) or with an index to a precoding matrix within a predefined codebook), the precoding matrix comprises a first precoding submatrix and a second precoding submatrix ([0047]: we refer to X i corresponding to the first N/2 rows in the overall precoder matrix as a first precoder sub-matrix), the first precoding submatrix corresponds to a first port group (fig. 5 and [0048]: a precoding operation from two antenna sub-arrays 510, 520 that are weighted by a first and a second precoder sub-matrices, respectively… the first precoder sub-matrix contains a sub-precoder for spatial layer 1 (530) and a sub-precoder for layer-2 (540) wherein the final precoder vector for layer-1 is the concatenation of 530 and 550 ), and the second precoding submatrix corresponds to a second port group ([0047]: ∂X i (or ß iXi ) corresponding to second N/2 rows as a second precoder sub-matrix; fig. 5 and [0048]: the second precoder sub-matrix has two sub-precoders for two spatial layers wherein… for layer-2 is a concatenation of 540 and 560 ), and send the first indication information ([0048]: each sub-matrix corresponds to one or more spatial layers of data transmission for the corresponding sub-array; [0075] and [0079]: in addition it feedbacks an additional second matrix corresponding to the whole wideband W 2 wb , such that the precoder obtained as the product W 1 WB W 2 wb can be used as a wideband precoder for all the sub-bands and this may be useful as a fallback option, for example, if the transmitted determines that the subband feedback is too outdated from the last report … it can be useful for a combined report of W 1 and W 2 to represent a precoder suitable for the entire frequency band, using minimal feedback overhead). Claim 38 (similarly claims 30 and 44). Sayana shows the apparatus according to claim 31, wherein information that is reported in the first indication information and that indicates linear combination coefficients are obtained through joint quantization ([0040]: the preferred PMI approximately represents a vector quantization of the dominant Eigenspace of R; fig. 4 and [0041]: a closely spaced 4-Tx uniform linear array (ULA), with a typical spacing of 0.5 to 1 wavelengths, is illustrated in 410; [0047]: a scaling or co-phasing coefficient; [0064]: select W 2 so that the first sub-matrix and second sub-matrix corresponding to the same spatial layer (i.e. same column) is equivalent, up to a linear scaling). ========== ========== ========== Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 24 – 29, 32 – 37 and 40 – 43 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. ---------- ---------- ---------- Conclusion The prior art made of record is considered pertinent to applicant’s disclosure. 1. Shabara et al, US 2025/0175222 A1: an apparatus, comprising processing circuitry configured to divide a plurality of antenna ports of the apparatus into multiple antenna groups each including one or more antenna ports that are coherent to each other within the respective group, the antenna ports from different groups not being coherent to each other; determine, for each antenna group, one or more layers to be transmitted by the respective antenna group; select, for each antenna group, one of a plurality of precoder submatrices based on a number of the one or more antenna ports included in the respective antenna group and a number of the one or more layers to be transmitted by the respective antenna group; and construct one or more precoder matrices for the plurality of antenna ports based on one or more combinations of the selected precoder submatrices. 2.
