Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1, applicant claims “to cause the signal processor to at least”. It is unclear what the signal processor is caused to do.
Regarding claim 1 and 10, applicant recites “correct the acquired complex amplitude by an antenna error correction value stored in advance, and further correct a phase of the corrected complex amplitude on the basis of the position of the object, to calculate an angle-calculation complex amplitude”. It is unclear what the phase “to calculate an angle calculation complex amplitude” is modifying. Does the claim calculate an angle complex amplitude after correcting in the complex amplitude or after correcting the complex amplitude and phase of the corrected complex amplitude. please clarify what the phase is modifying.
Allowable Subject Matter
Claims 1-18 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: Loesch (US 10379204) and Schoor (US 12000950) do not teach nor make obvious (claim 1 and 10) correct the acquired complex amplitude by an antenna error correction value stored in advance, and further correct a phase of the corrected complex amplitude on the basis of the position of the object, to calculate an angle-calculation complex amplitude.
