Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claims 1-4 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-5, 8 and 9 of US Patent granted of US Application No. 17573385.
Although the claims at issue are not identical in wording, they are not patentably distinct from each other because claims 1, 3 and 4 are broader in scope than thereof claims 1-4 and 9.
Claim 1 is identical is wording and scope as in claims 1 and 9 of the previously granted claims.
Claim 2 is depended on claim 1 and thus rejected as well and note the specification of previously granted application rejects claim 2 as well given that there is no real assigned meaning of segments that are just linear in continuous form of the same portion. In other words, the segments are just a continuous form of the same portion which is covered within the specification of the previously granted patent. Last, claim 2 reads on claims 5 and 8 of previously patented claims.

A multi-resonant antenna comprising:
a substrate having a pattern formed thereon;
a main antenna; and
an additional radiation element, wherein:
the main antenna comprises a main portion, which forms a split ring, and a feeding portion, which branches off from the main portion; the additional radiation element extends outward of the main antenna from the main antenna; the main antenna forms a first resonance portion; the first resonance portion comprises an LC resonance circuit; the additional radiation element forms at least a part of a second resonance portion different from the first resonance portion;
the multi-resonant antenna comprises a substrate with a pattern; and the main portion of the main antenna is formed of a combination of (i) at least one part of the pattern formed on the substrate and (ii) a metal member which is distinct and separated from the substrate and mounted on the substrate, at least one portion of the metal member being separated from the substrate.
2. The multi-resonant antenna as recited in claim 1, wherein: the multi-resonant antenna comprises a ground portion; and the additional radiation element does not overlap with the ground portion in a plan view.
A multi-resonant antenna comprising a main antenna and an additional radiation element, wherein:
the main antenna comprises a main portion and a feeding portion;
the main portion forms a split ring;
the feeding portion extends outward of the main antenna from the main portion; and
the additional radiation element extends outward of the main antenna directly from the feeding portion. (see claim 9 of previously patented claim)
2. The multi-resonant antenna as recited in claim 1, wherein:
the feeding portion comprises a first feeding point, a first feeding part, a second feeding point and a second feeding part;
the first feeding part has a first section and a second section;
the first section extends in a first predetermined direction from the main portion;
the second section extends from the first section in a second predetermine direction intersecting with the first predetermined direction; (note: it just extends as the same piece)
the second section has a first segment and a second segment; (note: “the second section” has no assigned meaning)
the first segment extends from the first section; (note: “the first segment” has no assigned meaning)
the second segment extends from the first segment;
in the second predetermined direction, a middle of the second section is positioned between the first segment and the second segment;
the first feeding point is provided at an end portion of the second segment in the second predetermined direction; (note: “first feeding point” has no assigned meaning)
the second feeding part extends from the main portion to the second feeding point; (note: “second feeding part” has no assigned meaning) and the additional radiation element extends from the second segment.
3. The multi-resonant antenna as recited in claim 2, wherein: the additional radiation element has a first extension portion extending in a first predetermined direction; and the ground portion has a second extension portion which is apart from the first extension portion in a second predetermined direction perpendicular to the first predetermined direction and which extends in the first predetermined direction.
4. The multi-resonant antenna as recited in claim 2, wherein the multi-resonant antenna further comprises an auxiliary radiation element which extends outward of the main antenna from the second feeding part.

4. The multi-resonant antenna as recited in claim 3, wherein: the ground portion has a third extension portion extending from the second extension portion in the second predetermined direction; and the first extension portion of the additional radiation element has a tip which is apart from and faces the third extension portion in the first predetermined direction.
3. The multi-resonant antenna as recited in claim 2, wherein: the second section has a linear portion extending linearly in the second predetermined direction;
the additional radiation element has an additional linear portion extending linearly in the second predetermined direction;
the linear portion and the additional linear portion are parallel to each other (see “tip”, in previously patented claim, is the additional linear portion extending linearly); and
the linear portion and the additional linear portion form an open slot which is opened at its end (because it is the “tip”).
5. The multi-resonant antenna as recited in claim 1, wherein the additional radiation element extends from the main portion of the main antenna.

the main portion of the main antenna has a first end portion and a second end portion; the feeding portion branches off from the main portion of the main antenna at a position closer to the first end portion than to the second end portion; and the additional radiation element extends from the main portion of the main antenna at a position closer to the first end portion than to the second end portion, or extends from the feeding portion.

10. The multi-resonant antenna as recited in claim 2, wherein the ground portion is integrally formed with the main portion of the main antenna.
11. The multi-resonant antenna as recited in claim 2, wherein: the multi-resonant antenna comprises a substrate with a pattern formed thereon; and the ground portion is formed of at least one part of the pattern formed on the substrate.
