Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 22, 25, 32, 35 is/are rejected under 35 U.S.C. 103 as being unpatentable over Kim US 20150334769 in view of Chen US 20180160347.
Regarding claim 22, 32, Kim teaches a wireless transmit/receive unit (WTRU) (UE, [0089]), comprising:
a processor ([0055])configured to:
determine that data associated with a logical channel is available in a buffer for a data transmission (When UE
transmits data using uplink resources allocated by eNB, it determines type of data to be transmitted, considering the orders of priority of logical channels allocated to respective bearers ([0089]).
Kim is silent on make a determination that one or more requirements associated with the data are not met, wherein the one or more requirements comprise a timing requirement indicating a maximum time to complete the data transmission;
in response to the determination, transmit a resource request associated with the logical channel to request a resource for the data transmission; and
perform the data transmission using the resource.
Chen teaches wireless transmit/receive unit (WTRU) (device 2, [0221]), comprising:
a processor ([0055])configured to:
determine that data associated with a channel is available in a buffer for a data transmission (the device 2 in the service group D detects that a current time-frequency resource does not satisfy a service requirement of the device 2, [0221]);
make a determination that one or more requirements associated with the data are not met, wherein the one or more requirements comprise a timing requirement indicating a maximum
time to complete the data transmission (the device 2 in the service group D detects that a current time-frequency resource does not satisfy a service requirement of the device 2, [0221]);
in response to the determination, transmit a resource request associated with the to request a resource for the data transmission (determines, by monitoring a resource in a network, a target resource and an idle resource that satisfy the service requirement of the device 2, and sends the target resource and the idle resource to the device 1 (a primary device), [0221]); and
perform the data transmission using the resource (the device 1 may directly instruct the device 2 to perform resource switching, and sends, to other devices in the service group D, the target resource and the switching time sent by the device 2, [0221], After receiving the first resource switching message sent by the primary device, the member devices in the service group obtain the first target resource and the first switching time from the first resource switching message. After the first switching time is reached, all member devices in the service group switch to the first target resource to transmit data, [0164]).
Therefore it would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention, to modify the system of Kim by make a determination that one or more requirements associated with the data are not met, wherein the one or more requirements comprise a timing requirement indicating a maximum time to complete the data transmission; in response to the determination, transmit a resource request associated with the logical channel to request a resource for the data transmission; and perform the data transmission using the resource, as suggested by Chen. This modification would benefit the system by enabling the WTRU to transmit data when then current resources to not meet the required resource requirements.
Regarding claim 25, 35, the processor is further configured to:
receive information about multiple resource requests. As shown above, Chen teaches the processor processing a single request. However, it is obvious that over the lifetime of the device, the device is capable of receiving multiple requests.
Allowable Subject Matter
Claims 23, 24, 26-31, 33, 34, and 36-41 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
