Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Claims 1-8 and 10-12 are pending. Claims 1-4 are examined on the merits. Claims 5-8 and 10-12 are withdrawn. Election/Restrictions Claims 5-8 and 10-12 are withdrawn further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected group, there being no allowable generic or linking claim. Election was made with traverse in the reply filed on 8/5/2026. Applicant's election with traverse of Group I (Claims 1-4) in the reply filed on 8/5/2026 is acknowledged. Because applicant did not distinctly and specifically point out the supposed errors in the restriction requirement, the traversal is unknown. The amendment to claim 6 appears to present the claim as a member of group II, the cosmetic active substance and is therefore withdrawn. Information Disclosure Statement The information disclosure statement (IDS) submitted on 12/24/2024 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-4 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Paufique (US 20080249064 A1). Paufique teaches a method of combating aging of the skin to smooth and diminish wrinkles comprising applying to the skin of a person in need of an active principle from alfalfa seed particle (Medicago sativa) in a cosmetically acceptable carrier (Claim 1), wherein the principle is a fraction rich in galactomannanes (Claim 2). The galactose are 52.5% [0055] and mannose are 39.1% [0054], which are more than at least 60%; therefore, Claim 4 limitation is met. Conclusion No claim is allowed.
