Office Action

§103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement submitted on 04/30/2026 and 05/22/2026, have been considered by the examiner and made of record in the application file. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or non-obviousness. This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. Claims 21, 26 and 28-40 are rejected under U.S.C. 103 as being unpatentable by Giatilis et al. (US 20230123854 A1, hereinafter Giatilis) in view of Koenig et al. (US 5586178 A, hereinafter Koenig). Consider Claim 21, Giatilis discloses A method implemented by a first device, the method comprising: transmitting a low-power response via a second wireless technology, the low-power response indicating a first device ID (RFID) of the first device, wherein the second wireless technology uses less power than the first wireless technology; (Paragraph 0018, as signaling protocol and work as a gateway for translating NFC (Near Field Communication) and/or Bluetooth signals into the signaling connection. In this way receiving personal data from the external portable network device. Paragraph 0023, a short-range wireless connection technology may be based on an NFC (Near Field Communication) protocol, a Bluetooth protocol and/or an RFID (Radio-Frequency Identification) protocol in some embodiments). Paragraph 0075, then all external portable network devices are identified which are located within the circle and are enabled for being scanned by the reporter's portable network device, wherein Bluetooth is lower energy source which requires less power). receiving an action input on an action key of the first device; and (paragraph 0075, a specific functionality may be activated via a button provided as a physical button on an operation panel and/or as a virtual button in the respective application). transmitting a position request via the first wireless technology(NFC), the position request including an indication of the action input(trigger signal) and an indication of the first device ID(external portable network device). (transmitting a position request via the first wireless technology, the position request including an indication of the action input and an indication of the first device ID (paragraphs 14, 75, 77, read as send a request/determine location data that includes tagging such as for criminal investigations or a court call (i.e. action input) and Automatic Location Identification (ALI), where this occurs via the Bluetooth technology). Giatilis discloses the claim invention but fail to teach receiving a device registration response via a first wireless technology, the device registration response including an address of a supervisor computer; However, Koenig teaches receiving a device registration response via a first wireless technology, the device registration response including an address of a supervisor computer (column 2 lines 12-23, an interface comprises transport means for receiving a supervisor signal from a host computer connected to a host terminal. The supervisor signal is comprised of a supervisor request code which indicates that an agent requests the assistance of the supervisor. The transport means maps the supervisor signal to a console control address for activating presentation means. The presentation means then uses the supervisor request code to activate software applications in the automatic call distributor, such that the automatic call distributor indicates to the supervisor that the agent requests assistance). Koenig teaches transmitting an operation authorization via the first wireless technology, the operation authorization indicating the first device ID and the address of the supervisor computer; (column 4 lines 16-35, the agent 112 signals to the host computer 108 by means of the input device 200 of the host terminal 114 that the assistance of the supervisor 116 is requested. The keyboard keys which initiate the supervisor assist function is determined by computer programs resident in the host computer 108. In response to the agent's request, the host computer 118 generates a supervisor signal which is transmitted to the transport means 206 of the interface 204. The supervisor signal, which is preferably digital, is comprised of a record type, a position identification code and a request code. The record type is used by the transport means 206 to activate the presentation means 208. The position identification code uniquely identifies the agent who requested the assistance or the host terminal from which the request was made. The request code indicates the function that is to be performed by the ACD 102, “ the communication request is to a supervisor computer”). Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 21, by Giatilis method of incorporating signaling connection between the network device and PSAPs of with the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig. The motivation to do so would be a method for realizing telephonic communication implemented by a device i.e. wireless accessory for a telephone and to provide an efficient emergency solution that can address and improve conventional approaches in wireless communication systems. Consider Claim 26, Giatilis discloses receiving a low-power request via the second wireless technology, wherein the first wireless technology is Bluetooth or WiFi, and the second wireless technology complies with a near-field communication (NFC) protocol (paragraph 0018, description Protocol) as signaling protocol and work as a gateway for translating NFC (Near Field Communication) and/or Bluetooth signals into the signaling connection. In this way receiving personal data from the external portable network device). Consider Claim 28, Giatilis discloses an apparatus, comprising: a first pad including an action key; and (paragraph 0075, a specific functionality may be activated via a button provided as a physical button on an operation panel and/or as a virtual button in the respective application). the network interface transmits a low-power response via a second wireless technology, the low-power response indicating a first device ID(RFID) of the apparatus, the second wireless technology uses less power than the first wireless technology, (paragraph 0018, description Protocol) as signaling protocol and work as a gateway for translating NFC (Near Field Communication) and/or Bluetooth signals into the signaling connection. In this way receiving personal data from the external portable network device. Paragraph 0023, a short-range wireless connection technology may be based on an NFC (Near Field Communication) protocol, a Bluetooth protocol and/or an RFID (Radio-Frequency Identification) protocol in some embodiments). the network interface receives an action input on the action key, and (paragraph 0075, a specific functionality may be activated via a button provided as a physical button on an operation panel and/or as a virtual button in the respective application). the network interface transmits a position request via the first wireless technology, the position request including an indication of the action input and an indication of the first device ID. (Paragraph 0014, an operator of the PSAP, can be provided to assist to perform some actions when the call taker tries to assess the reported incident. It may be possible to log the reporter's phone number, e.g. the phone number of the caller, and in this way already getting an identification of the caller. In addition, it may be possible to determine the location data of the caller who may call from a place that he or she is not familiar with. For retrieving location information, a location-based service may be used such as Automatic Location Identification (ALI)). Giatilis discloses the claimed invention but fails to teach a network interface that receives a device registration response via a first wireless technology, the device registration response including an address of a supervisor computer, wherein. However, Koenig teaches a network interface that receives a device registration response via a first wireless technology, the device registration response including an address of a supervisor computer, wherein (column 2 lines 12-23, an interface comprises transport means for receiving a supervisor signal from a host computer connected to a host terminal. Koenig teaches the network interface transmits an operation authorization via the first wireless technology, the operation authorization indicating the first device ID and the address of the supervisor computer; (column 4 lines 16-35, the agent 112 signals to the host computer 108 by means of the input device 200 of the host terminal 114 that the assistance of the supervisor 116 is requested. Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 28, by Giatilis method of incorporating signaling connection between the network device and PSAPs of with the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig. The motivation to do so would be a method for realizing telephonic communication implemented by a device i.e. wireless accessory for a telephone and to provide an efficient emergency solution that can address and improve conventional approaches in wireless communication systems. Claims 22 are rejected under U.S.C. 103 as being unpatentable by Giatilis et al. (US 20230123854 A1, hereinafter Giatilis) in view of Koenig et al. (US 5586178 A, hereinafter Koenig) in view of Taillant et al. (US 20130251135 A1, hereinafter Taillant) and in view of Arestani et al. (US 9392523 B1, hereinafter Arestani). Consider Claim 22, Giatilis discloses the claimed invention above the method of Claim 21, further comprising: but fails to teach receiving audio of a telephone call via the first wireless technology; and. However, Taillant teaches receiving audio of a telephone call via the first wireless technology; and (paragraph 0032, a mobile terminal TM comprises a device or electronic telecommunications object that is personal to the user and which can be a communicating personal digital assistant PDA ("Personal Digital Assistant"), or smartphone, or a personal computer, which may be connected to an access terminal of a short-range wireless network). Giatilis fails to teach outputting the audio of the telephone call via a headphone jack or a wireless communication unit of the first device. However, Arestani teaches outputting the audio of the telephone call via a headphone jack or a wireless communication unit of the first device (section 1 line 46-50, a user may utilize short-range wireless communication technology to receive a voice call on a user device (e.g., a mobile device) and forward the voice call to a headset (e.g., a Bluetooth headset) that the user is wearing). Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 22, by incorporating Giatilis and the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig with Taillant method of signaling connection between the network device and PSAPs of and method involves determining an identifier (IdZ) i.e. radiofrequency identification reader of which an agent is connected to a call center server (SCA) involving establishing a call between a portable network device and a public service answering point (PSAP) with and adding the Alternate Call Path Using Short-range Wireless Technology of Arestani. The motivation to do so would be develop a method for realizing telephonic communication implemented by a device i.e. wireless accessory for a telephone and a telephone cradle, creating real-time status information about an agent or group of agents. In addition, by controlling a state of an agent of a call center through a mobile terminal (claimed) i.e. cellular mobile radio communication terminal, reducing delay, improve enable or disable scanning, choosing the wireless modes, and limiting access with tokens or encryption will provide better accuracy in a wireless communication system. Claims 23-24 are rejected under U.S.C. 103 as being unpatentable by Giatilis et al. (US 20230123854 A1, hereinafter Giatilis) in view of Koenig et al. (US 5586178 A, hereinafter Koenig) in view of Arestani et al. (US 9392523 B1, hereinafter Arestani). Consider Claim 23, Giatilis discloses the claimed invention above but fails to teach receiving a voice input; and However, Arestani teaches receiving a voice input (section 1 line 65-66, the user may receive a voice call on either the user device or the wearable device). Arestani teaches transmitting an indication of the voice input via the first wireless technology (section 2 line 49-52, a modem and voice calls may be received either by the user device and then forwarded to the call transfer device or by the call transfer device). Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 23 by incorporating Giatilis method of incorporating signaling connection between the network device and PSAPs with the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig and adding the Alternate Call Path Using Short-range Wireless Technology of Arestani. In addition, to controlling a state of an agent of a call center through a mobile terminal (claimed) i.e. cellular mobile radio communication terminal, reducing delay, improve enable or disable scanning, choosing the wireless modes, while providing better accuracy in a wireless communication system. Consider Claim 24, Giatilis discloses the claimed invention but fails to teach receiving a numeric input on a numeric key of the first device; and However, Arestani teaches receiving a numeric input on a numeric key of the first device; and (column 5 line 19-22, input component 350 may include a component that permits device 300 to receive information, such as via user input (DTMF) (e.g., a touch screen display, a keyboard, a keypad, a mouse, a button, a switch, a microphone, etc.). Arestani teaches transmitting an indication of the numeric input via the first wireless technology, wherein a dual-tone multi-frequency (DTMF) tone is generated, at least in part based on the numeric input (column 9 line 23-36, the user of call transfer device 250 may select call reception device 270 from a list of devices provided on the user interface of call transfer device 250 based on the device information. Additionally, or alternatively, call transfer device 250 may synchronize a frequency and a clock value of call transfer device 250 with a frequency and a clock value of call reception device 270, establishing a link between call transfer device 250 and call reception device 270 (DTMF is used in telecommunications to transmit dialed digits or symbols over voice lines (i.e. “touchtone)). Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 23 by incorporating Giatilis method of incorporating signaling connection between the network device and PSAPs with the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig and for managing the femto zone in a wireless communication network to include the Alternate Call Path Using Short-range Wireless Technology of Arestani. The motivation to do so would be develop a method for realizing telephonic communication implemented by a device i.e. wireless accessory for a telephone and a telephone cradle, creating real-time status information about an agent or group of agents. In addition, to controlling a state of an agent of a call center through a mobile terminal (claimed) i.e. cellular mobile radio communication terminal, reducing delay, improve enable or disable scanning, choosing the wireless modes, while providing better accuracy in a wireless communication system. Claims 25 and 27 are rejected under U.S.C. 103 as being unpatentable by Giatilis et al. (US 20230123854 A1, hereinafter Giatilis) in view of Koenig et al. (US 5586178 A, hereinafter Koenig) in view of Taillant et al. (US 20130251135 A1, hereinafter Taillant). Consider Claim 25, Giatilis discloses claim invention the method of Claim 21, further comprising but fail to teach establishing a position connection with a second device, via the first wireless technology; and. However, Taillant teaches establishing a position connection with a second device, via the first wireless technology; and (paragraph 0019, the data management server (second device) in order to retrieve within a first lookup table an identifier of the agent associated with the identifier of the geographic area). Taillant teaches receiving a second device ID of the second device via the first wireless technology, wherein the position request is at least in part based on the second device ID. (Paragraph 0020, means for transmitting a second request comprising the agent's identifier to the call center server in order to retrieve within a second lookup table the agent's status data associated with the agent's identifier). Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains, to modify Claim 25, by Giatilis method of incorporating signaling connection between the network device and PSAPs of with the method involves establishing a call between a portable network device and a public service answering point (PSAP) and interface for automatic call distributor for performing agent functions via host computer of Koenig and Taillant method of signaling connection between the network device and PSAPs of with method involves determining an identifier (IdZ) i.e. radiofrequency identification reader of which an agent is connected to a call center server (SCA) involving establishing a call between a portable network device and a public service answering point (PSAP). Consider Claim 27, Giatilis discloses the claim invention the method of Claim 21, further comprising: but fail to teach transmitting a device registration request via the first wireless technology, the device registration request indicating the first device ID. However, Taillant teaches transmitting a device registration request via the first wireless technology, the device registration request indicating the first device ID (Paragraph 0056, in step E3, the communication module MC of the mobile terminal TM transmits a first request comprising the geographic area's identifier IdZ to the data management server SGD in order for it to identify in a lookup table IdA the identifier of the agent associated with the identifier IdZ. Paragraph 0013, in response to the agent connection to the call center server via the communication terminal associated with the geographic area, the call server may save an identifier of the agent as a match for the agent's status data).
