CTFR 18/823,966 CTFR 90389 Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Response to Arguments 07-37 AIA Applicant's arguments filed 12/12/2025 have been fully considered but they are not persuasive. The examiner should remind the applicant that, per USPTO examination guidelines, pending claims are construed using the Broadest Reasonable Interpretation (BRI) in light of the specification. Regarding applicants argument that Bucknor contains no disclosure that distribution currents of two batteries are determined based on the SoC of the first battery, the examiner respectfully disagrees with applicant. The claim language does not limit or combine the output in any manner the recitation highlighted by applicant is sufficient to address the claim language as currently drafted. Further applicant amendments that “ State of Charge (SoC) of the first battery and at least one set SoC, it is interpreted by the examiner that the current SoC of the first battery is the same as at least one set SoC”, neither the specification nor claims indicate that the values cannot be the same. All other remarks are considered yet not found persuasive. The Examiner suggest amendments to the claims that include structural differences between the prior art and current application . Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 1 and 11 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by Bucknor (US 2022/0126714) . Regarding claim 1, Bucknor teaches a mobility apparatus (see Fig. 1) comprising: a plurality of first wheels (see 26, Fig. 1) ; at least one first drive motor configured to provide driving force to the plurality of first wheels (para 0009, 0032, Fig. 1) ; a first battery configured to supply power to the at least one first drive motor (see 22, Fig. 1) ; and a first controller configured to control the at least one first drive motor and the first battery (see 28, Fig. 1) ; wherein, in a state in which a second battery is detachably connected to supply power to the at least one drive motor (see 17, Fig. 1) , the first controller is configured to determine distribution currents of the first battery and the second battery based on a State of Charge (SoC) of the first battery and at least one set SoC in response to a request torque (see para 0034-0038, 0045-0051) . Regarding claim 11, Bucknor teaches a method of controlling a battery of a mobility apparatus, the mobility apparatus comprising a plurality of first wheels, at least one first drive motor configured to provide a driving force to the plurality of first wheels, a first battery configured to supply power to the at least one first drive motor, and a first controller configured to control the at least one first drive motor and the first battery; wherein, when a second battery is detachably connected to supply power to the at least one drive motor, the first controller is configured to determine distribution currents of the first battery and the second battery based on a State of Charge (SoC) of the first battery and at least one set SoC in response to a request torque (please see the rejection of claim 1) . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 2 and 12 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 3-10 and 13-20 are dependent of claim 2 and 12 reactively. Conclusion 07-39 AIA THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
