Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to because figures 3, 5, 6, 7, disclose blocks without text label, the unlabeled rectangular boxes shown in the drawing should be provided with descriptive labels. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Objections Claims 22 and 24-27 are objected to because of the following informalities: (1) Regarding claim 24: Lines 1-2 recite “the step of providing encrypted eSIM profile data together with encrypted confidential user data”; the examiner suggest changing to “the step of providing the encrypted eSIM profile data together with the encrypted confidential user data” since these terms were recited in claim 16. (2) Regarding claim 25: Lines 1-2 recite “the step of providing encrypted eSIM profile data together with encrypted confidential user data”; the examiner suggest changing to “the step of providing the encrypted eSIM profile data together with the encrypted confidential user data” since these terms were recited in claim 16. (3) Regarding claim 26: Line 11 recites “the confidential user data”; the examiner suggests changing to “the encrypted confidential user data”. (4) Regarding claim 27: Line 13 recites “the confidential user data”; the examiner suggests changing to “the encrypted confidential user data”. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 22 and 26 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. (1) Regarding claim 22: Claim 22 recites the limitation "the key creation material" in line 1. There is insufficient antecedent basis for this limitation in the claim. (2) Regarding claim 26: Claim 26 recites the limitation "the encryption key for the confidential user data" in line 12-13. There is insufficient antecedent basis for this limitation in the claim. Allowable Subject Matter Claims 16-20, 21, 23 are allowed. Claims 24-25 and 27 are objected to for minor informality, but would be allowable if rewritten to overcome the objections. The following is a statement of reasons for the indication of allowable subject matter: The present invention describes a method for transferring eSIM profile data from a first wireless communication device having a first eUICC device to a second wireless communication device having a second eUICC device, the method comprising providing encrypted eSIM profile data together with encrypted confidential user data on the first eUICC device, wherein the encrypted eSIM profile data has been encrypted using profile encryption keys, and wherein the encrypted confidential user data has been encrypted at least partially using a user key; transferring the encrypted eSIM profile data together with the encrypted confidential user data from the first eUICC device to the second eUICC device; and decrypting and installing the encrypted eSIM profile data on the second wireless communication device, wherein the confidential user data are decrypted and installed on the second wireless communication device at least partially using the user key. The closest prior art, Cha et al. (US 2016/0241537 A1) discloses method for transferring profile and electronic device comprising communication interface 160 receives device information from the target electronic device or transfers the target profile (or an encrypted profile) or user data associated with the target profile to the target electronic device, but fails to disclose providing encrypted eSIM profile data together with encrypted confidential user data on the first eUICC device, wherein the encrypted eSIM profile data has been encrypted using profile encryption keys, and wherein the encrypted confidential user data has been encrypted at least partially using a user key; transferring the encrypted eSIM profile data together with the encrypted confidential user data from the first eUICC device to the second eUICC device; and decrypting and installing the encrypted eSIM profile data on the second wireless communication device, wherein the confidential user data are decrypted and installed on the second wireless communication device at least partially using the user key. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Park et al. (US 12,457,487 B2) discloses electronic device and method for installing eSIM profile in electronic device. Lim et al. (US 11,950,320 B2) discloses apparatus and methods for linkage of or profile transfer between devices. Balasubramanian et al. (US 11,838,984 B2) discloses hierarchical database architecture for subscriber credential management in enterprise networks. Cha et al. (US 2016/0241537 A1) discloses method for transferring profile and electronic device supporting the same. Mathur et al. (US 2016/0219073 A1) discloses encryption levels for secure application containers. Dash et al. (US 2023/0362631 A1) discloses secure storage and processing of SIM data.
