Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 6, and 8 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Parsels et al (CN 111886150).
Parsels et al disclose a method for improving vehicle noise generated from a centrifugal pendulum absorber (CPA) after a vehicle turns off, the method comprising: collecting real-time driving information (see page 8 ¶4) according to an operation of the vehicle through a driving information detector (102); determining whether an idle condition is satisfied based on the real-time driving information (see page 12 ¶4); determining whether a transmission P stage is engaged (see page 8 ¶4) and whether a brake operates when the idle condition is satisfied (see page 5 ¶7); and reducing rotation of a CPA mounted turbine applied to a torque converter through at least one of transmission clutch and brake operations at a time when an engine turning-off signal is input in a state of satisfying the transmission P stage engagement or brake operation condition (see page 10 ¶5 – page 11 ¶1).
Re claim 6, control device for improving vehicle noise generated from a centrifugal pendulum absorber (CPA) after a vehicle turns off, the control device comprising: a driving information detector (102) configured to detect real-time driving information required for controlling improvement of CPA noise from various sensors according to an operation of the vehicle (see page 8 ¶4); and a controller (125) configured to reduce rotation of a CPA mounted turbine applied to a torque converter through at least one of transmission clutch and brake operations when an engine turning-off signal is input in a state of satisfying an idle condition according to the real-time driving information, and satisfying a transmission P stage engagement or brake operation condition (see page 10 ¶5 – page 11 ¶1).
Re claim 8, the driving information detector (102) is further configured to detect real-time driving information including at least one of an engine start state (see page 8 ¶4), an engine RPM, a transmission (TM) state, a TM clutch state, a brake pedal sensor (165), and a vehicle speed (169), and delivers the detected real-time driving information to the controller (125).
Allowable Subject Matter
Claims 2-5 and 7 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
