DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This Office action is in response to the application filed 09/05/2024. Claims 1-9 are pending. Information Disclosure Statement The information disclosure statement filed 09/05/2024 fails to comply with 37 CFR 1.98(a)(2), which requires a legible copy of each cited foreign patent document; each non-patent literature publication or that portion which caused it to be listed; and all other information or that portion which caused it to be listed. It has been placed in the application file, but the information referred to therein has not been considered. No copy of the French Search Report for FR 2309431 has been provided. Specification Applicant is reminded of the proper language and format for an abstract of the disclosure. The abstract should be in narrative form and generally limited to a single paragraph on a separate sheet within the range of 50 to 150 words in length. The abstract should describe the disclosure sufficiently to assist readers in deciding whether there is a need for consulting the full patent text for details. The language should be clear and concise and should not repeat information given in the title. It should avoid using phrases which can be implied, such as, “The disclosure concerns,” “The disclosure defined by this invention,” “The disclosure describes,” etc. In addition, the form and legal phraseology often used in patent claims, such as “means” and “said,” should be avoided. The abstract of the disclosure is objected to because the abstract begins with the implied phrase “The invention relates to”. A corrected abstract of the disclosure is required and must be presented on a separate sheet, apart from any other text. See MPEP § 608.01(b). Drawings The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they include the following reference character(s) not mentioned in the description: Reference characters “6” and “11” are not mentioned in the specification. Corrected drawing sheets in compliance with 37 CFR 1.121(d), or amendment to the specification to add the reference character(s) in the description in compliance with 37 CFR 1.121(b) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the “the receptacle has an assembly of seal(s) configured to cooperate with the coupling and to isolate the internal volume of the sleeve from the exterior of the sleeve” in claim 1; “a detector configured to detect the presence of the coupling in the sleeve and/or a temperature sensor in the sleeve” in claim 7; “an assembly of O-ring seal(s) disposed at the inlet of the sleeve and/or on the coupling” in claim 9 must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-9 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 1 recites “wherein the receptacle has an assembly of seal(s) configured to cooperate with the coupling and to isolate the internal volume of the sleeve from the exterior of the sleeve” however no assembly is labeled in the drawings, and it is not explicitly clear where this assembly is within the receptacle and fails to comply with the written description requirement. It appears reference character “6” that has not been described in the specification may be an O-ring which can be interpreted as a seal and this is how the claim will be interpreted for purposes of examination. Claims 2-9 are included in the rejection for their dependency to claim 1. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites “the receptacle has an assembly of seal(s) configured to cooperate with the coupling and to isolate the internal volume of the sleeve from the exterior of the sleeve” which renders the claim indefinite because it is not clear what “assembly of seal(s)” is being referred to and renders the scope of the claim unclear and indefinite. It appears reference character “6” that is not described in the specification is an O-ring and therefore claim 1 will be interpreted as “the receptacle has a seal configured to cooperate with the coupling and to isolate the internal volume of the sleeve from the exterior of the sleeve” for purposes of examination. Regarding claims 3-5, the phrase "for example" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. See MPEP § 2173.05(d). Claims not explicitly referenced are included in the rejection based on their dependency to an indefinite claim. Allowable Subject Matter Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: The prior art does not anticipate nor render obvious the combination set forth in the independent claims, and specifically does not show "A receptacle for receiving a cryogenic coupling for filling between two uses, the receptacle comprising: a tubular sleeve which has an inlet and a bottom… a drying module provided with removable attachment member(s) at the end of the tubular sleeve delimiting the bottom…wherein the bottom of the tubular sleeve comprises an intake valve configured to be connected with the circulation channel when the drying module is in its first position and to admit a flow of drying gas into the sleeve, wherein the receptacle has a seal configured to cooperate with the coupling and to isolate the internal volume of the sleeve from the exterior of the sleeve” recited in claim 1. The closest prior art of record (Sjoberg et al.—WO 2022/225442) discloses a receptacle for receiving a cryogenic coupling for filling between two uses including a tubular sleeve and drying module with many of the limitations claimed, but not having a tubular housing configured to accommodate a coupling of cylindrical overall shape in an airtight manner and the bottom of the tubular sleeve comprises an intake valve configured to be connected with the circulation channel when the drying module is in its first position and to admit a flow of drying gas into the sleeve. Although it is well known to provide a sealing gasket for a coupling valve for cryogenic fluids (Goode—US 5,301,723; Mauvais—FR 3104671; Akinori et al.—WO 2009/084388), there is no teaching in the prior art of record that would, reasonably and absent impermissible hindsight, motivate one having ordinary skill in the art to modify the teachings of the prior art to incorporate a receptacle for receiving a cryogenic coupling including the combination of technical features in the arrangement as claimed. Thus, for at least the foregoing reasons, the prior art of record neither anticipates nor rendered obvious the present invention as set forth in claim 1.
