Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Remarks
The present Office Action is based upon the Applicant’s amendment filed on July 24, 2026. Claims 1-12 are now pending in the present application.
For purpose of compact prosecution of the Applicant and placing the Application in condition of allowance, Examiner called Attorney’s office on September 15, 2026 and left a voice message for Mr. William A. Munck (Registration No. 39,308) and requested to discuss how to amend the claims to overcome 35 USC 112(a) rejections. However, as of Friday, September 18, 2026, no call was received from the Attorney’s office.

Terminal Disclaimer
The terminal disclaimer filed on 07/24/2026 disclaiming the terminal portion of any patent granted on this application which would extend beyond the expiration date of US Patent # 11,950,143 has been reviewed and is accepted. The terminal disclaimer has been recorded.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim(s) 1-12 is/are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
Claim 1 recites, “receiving, from the CU-UP of the target base station, a bearer context setup response message, as a response to the bearer context setup request message…” However, the current specification does not support the limitation.
Claim 4 recites, “transmitting, to the CU-CP of the target base station, a bearer context setup response message, as a response to the bearer context setup request message…” However, the current specification does not support the limitation.
Claim 7 recites, “receive, from the CU-UP of the target base station, a bearer context setup response message as a response to the bearer context setup request message…” However, the current specification does not support the limitation.
Claim 10 recites, “transmit, to the CU-CP of the target base station, a bearer context setup response message as a response to the bearer context setup request message…” However, the current specification does not support the limitation.
Claim(s) 2-3, 4-5, 8-9, 11-12 is/are also rejected by the virtue of it/their dependency on claims 1, 4, 7 and 10.
Applicant is welcomed to point out to the portion(s) of the specification that provides support for the limitation(s).
