DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-9 are currently pending. Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-9 is/are rejected under 35 U.S.C. 102(a) (1) as being anticipated by Lim et al. (US 20210336820 A1). Regarding claim 1, Lim et al. disclose a first wireless communication device that performs pre-allocated communication to communicate with a second wireless communication device, using a preconfigured radio resource, the first wireless communication device comprising: a controller configured to receive data transmitted on an adjusted radio resource obtained by adjusting a timing of a preconfigured pre-allocated radio resource to a predetermined different timing (paragraph [0362]; configuration may need to be changed to delay the configured transmission timing and transmit the SRS at the delayed transmission timing (SRS data is received at the delayed (adjusted) transmission timing (of the pre-configured SRS transmission time/resource)). Regarding claim 2, Lim et al. further suggest wherein the second wireless communication device transmits a control signal that indicates that the adjustment is to be performed on a radio resource individually allocated to the second wireless communication device, and the controller receives the control signal (paragraph [0533]; When the UE is unable to dynamically change the transmission timing of the AP SRS, in steps 36-40 and 36-45, the BS configures a higher layer parameter for an SRS resource set in the UE, and performs AP SRS triggering). Regarding claim 3, Lim et al. further suggest wherein the adjustment is performed when the second wireless communication device is unable to transmit data on the pre-allocated radio resource (paragraph [0362]; an AP SRS is unable to be transmitted, a configuration may need to be changed to delay the configured transmission timing and transmit the SRS at the delayed transmission timing). Regarding claim 4, Lim et al. further suggest wherein, when data is not able to be transmitted on the adjusted radio resource, the adjustment is further performed in the second wireless communication device (paragraph [0406]; when the UE is unable to transmit an AP SRS at a triggered (delayed) transmission timing, the UE may automatically delay a transmission timing until the AP SRS is able to be transmitted). Regarding claim 5, Lim et al. further suggest wherein the second wireless communication device retransmits the control signal when the adjustment is further performed, and the controller receives the control signal (paragraph [0427]; when the BS indicates a new offset for dynamically determining a transmission timing of an AP SRS through DCI, the DCI for indicating the new offset may include 1) a main operation field, 2) a detailed operation field, 3) an AP SRS resource set ID field for performing an operation, and 4) a new offset field according to an RRC configuration according to a UE capability of the UE and a transmission timing change operation to be indicated). Regarding claim 6, Lim et al. further suggest wherein the second wireless communication device does not retransmit the control signal when the adjustment is to be further performed, and the controller recognizes that the adjustment is to be further performed when being unable to receive data on the adjusted radio resource (paragraph [0408]; when the triggered AP SRS is unable to be transmitted (not received) at an indicated timing, the UE may may automatically delay the triggered AP SRS till a next AP SRS transmittable resource). Regarding claim 7, Lim et al. further suggest wherein the controller configures a timing at which the adjusted radio resource is not able to be used (paragraphs [0346-0347]; DCI for flexible offset control according to a transmittable UL resource and a triggered AP SRS. The term ‘flexible offset control’ refers to dynamically determining a transmission timing of an AP SRS, which is semi-statically configured, by using an offset that is additionally indicated through DCI). Regarding claim 8, Lim et al. further suggest wherein the adjustment includes using a radio resource obtained by shifting the pre-allocated radio resource backward in a time axis as the adjusted radio resource (paragraph [0362]; configuration may be changed to transmit the AP SRS at a timing earlier (backward) than the configured SRS transmission timing). Regarding claim 9, Lim et al. disclose a second wireless communication device that performs pre-allocated communication to communicate with a first wireless communication device, using a preconfigured radio resource, the second wireless communication device comprising: a second controller configured to: adjust a timing of a preconfigured pre-allocated radio resource to a predetermined different timing, transmit data on the adjusted radio resource, and control execution of the pre-allocated communication (paragraph [0362]; configuration may need to be changed to delay the configured transmission timing and transmit the SRS at the delayed transmission timing (SRS data is received at the delayed (adjusted) transmission timing (of the pre-configured SRS transmission time/resource)).
