DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-16 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Elshafie et al. (12,471,108) [Elshafie]. Regarding claims 1-16, Elshafie discloses a method performed by a user equipment (UE) in a wireless communication system, the method comprising: receiving, from a base station, downlink control information (DCI) scheduling a physical uplink shared channel (PUSCH) transmission (col. 11 line 59 – col. 12 line 7), the DCI including information on a frequency resource for the PUSCH transmission and information indicating whether frequency hopping to be applied to the PUSCH transmission (col. 24 lines 40-49); and transmitting, to the base station, a PUSCH, based on precoding applied according to a predetermined resource unit based on the frequency resource for the PUSCH transmission (col. 26 lines 38-58). The scope of the claims is inclusive of transmissions that do not necessarily indicate frequency hopping is applied nor explicitly indicate precoding is wideband based precoding. The prior art rejection applied above addresses said claimed instances where the claimed “in case” clauses are not fully satisfied and the subsequent selective precoding steps are not applied. Allowable Subject Matter The following is a statement of reasons for the indication of allowable subject matter: The “in case” clause recited in the claims refers to a specific situation wherein information is included in the downlink control information that specifies both frequency hopping is applied and precoding is wideband based, and satisfaction of the clause results in size selective precoding being applied to transmission portions based on which frequency each portion occupies. The prior art does not appear to teach or reasonably suggest size based selective precoding in this manner at the time of effective filing.
