The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This office action is in response to Pre-Amendment filed on Jul. 23, 2024.
Claims 1-9, 11, 14-19 and 23 have been amended.
Claims 20-22 and 24-34 have been canceled.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 12 and 23 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Shikama (2015/0009839).
Regarding claim 1, Shikama discloses an information output device comprising one or more memories storing instructions and one or more processors configured to execute the instructions to (see abstract, fig.4, elements 402, 401, paragraphs [0014], [0099], [0101] and its description): receive, for an in-use communication being a wireless communication used by wireless communication means for performing wireless communication, quality information being information about quality of the in-use communication from the wireless communication means (see abstract, fig.3, element 310, paragraphs [0014], [0084], [0088] and its description); estimate occurrence of radio interference on the in-use communication, based on the quality information (see abstract, fig.3, element 330, paragraphs [0014], [0084], [0092] and its description); acquire alternative communication information from storage when occurrence of the radio interference on the in-use communication is estimated (see abstract, fig.3, element 320/350, paragraphs [0014], [0084-0085], [0089], [0092] and its description); and output information including the alternative communication information, wherein the storage stores communication information being information about a wireless communication for each wireless communication available to the wireless communication means, the alternative communication information is the communication information of an alternative communication being a wireless communication available to the wireless communication means in place of the in-use communication, and the alternative communication is a wireless communication using a wireless communication method different from that used by the in-use communication or a wireless communication provided by an operator different from that of the in-use communication (see abstract, fig.3, elements 340,350, 360, paragraphs [0014], [0084], [0095-0097] and its description).
Regarding claims 12 and 23recite limitations substantially similar to claim 1. Therefore, these claims were rejected for similar reasons as stated above.
Allowable Subject Matter
Claims 2-11 and 13-19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
